Helloe fellow Vj'ers,

Just wanna ask a quick question regarding the I-864 and Ds-230. My husband is the petitioner and my 2 kids in the Philippines are the I=130 benefeciary.

I am the kid's biological mother and the agent.

My questions are:

1. CAn i sign the part 1 of the DS 230 form or should be signed by the minor benefeciary? If signed by kids does it have to be the original DS-230 form or scanned form and signed is okay?

2. In sending the documents to NVC and for AOS do we need to submit original documents? or photocopy will be okay and the original documents will be presented during the interview ?

3. In Affidavit of Support, do i need t o put just my husband's annual income or both our income since we filed jointly??

4. If i put just hubby's income do i need to fill out I-864 A as well? aside from the I-864 that my sis in law being our co-sponsor will fill up?

5.The photo of the beneficiary (7 & 11) does it need to be signed by the kids at the back or dont need to as long as it has the case #?

Please am really not sure what to do..I would greatly appreciate any help you can extend.Thank you so much in advance.

Since the beneficiaries are minors, as a mother you can sign on behalf of minors. You need to send in Original DS-230 (including signatures) no copies or scanned copies are accepted.

2. In sending the documents to NVC and for AOS do we need to submit original documents? or photocopy will be okay and the original documents will be presented during the interview ?

The documents for I-864 can be copies but the documents that you send in along with DS-230 needs to be Originals and copies of all the Originals and they will be returned at the time of interview.

3. In Affidavit of Support, do i need t o put just my husband's annual income or both our income since we filed jointly??

As a petitioner your husband will file I-864 and he needs to put his income on I-864 (you husband need to send in his W-2's and the last 6 months current pay stubs along with last 3 years IRS Tax Transcripts.) We file jointly but when i petitioned my parents, i filled in I-864 and i put my income on i-864 i submitted all these above documents...

4. If i put just hubby's income do i need to fill out I-864 A as well? aside from the I-864 that my sis in law being our co-sponsor will fill up?

If you are the co-sponsor then you need to fill out I-864a otherwise your sis-in-law will fill in i-864a.

5.The photo of the beneficiary (7 & 11) does it need to be signed by the kids at the back or dont need to as long as it has the case #?

Signatures are not required on the back of the photos, but it is advised to write the NVC Case # and the name of the beneficiary on the back side of the photo.

Please am really not sure what to do..I would greatly appreciate any help you can extend.Thank you so much in advance.
