I would like to thank you to all of the forum member here, all the comments is meant a lot for us...

But now I still have more question...:

My husband will ask his brother whom living in different state with him to be our co-sponsor...my husband live in California and his brother live in Chicago,.which form he should fill in..I-864 or I-864A????

And what document he need to attach together with the form??? Beside his most recent tax return 1040 & W2...he is USA citizen born and live in USA...

Does he need to attach his bank statement that shown his coming income regularly, passport copy and any other ID card?????

I am waiting for your info and help.. Thank you very much in advance...

864A is for household members.

Since the brother is not in the same household, he would use the 864.

You should include 3 years tax transcripts to the 864 - easier in the long run. (current pay stubs, etc - if you wish to help your case, as per the instructions)

The USC will have to prove that they are an USC - so passport is usually the best way. LPR's would use their greencard.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I-864. With regular documentation and proof of his citizenship.

09/25/2013: N-400 NOA1

10/16/2013: Biometrics completed

Neither the I-864 or 864a is used in a K visa case. If pursuing a K visa, each sponsor completes an I-134.

K visas use the I-134...when you apply to adjust your status you apply using the I-864

The guides say if you are doing a K-3 visa, it depends on the consulate.

Removal of conditions Journey

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Each sponsor completed the I-134??? is that together with I-864??

For K visas, the I-864 is used only when adjusting status after US arrival.
