This is very new to me so I'm not sure how to start.

My husband and I are married and no kids. My main concern is how to prove extreme hardship so that they can approve our case. I just fear that b/c we don't have any kids they will dismiss or deny our case. We have been married for over 3 years and he is currently in Mexico due to voluntary departure (warrants for unpaid traffic tickets). One of the main reasons that we didn't have any kids was the fact that I was going to college. We were planning on having kids after I graduated but all this happened and that stopped our plans.. ugh... Has anyone gone through this and what are the success rates for approving these types of cases...

Any ideas??

Children don't necessarily help waiver approval since they are not qualifying relatives. There are TONS of waivers approved in Mexico for couples without children. It's realy hard to give you ideas without knowing your exact situation because the circumstances of the case are just as important as the hardships.

How did he enter the country? Any criminal record other than the tickets? Any formal removals? How many times has he entered the US?

In Mexico, about 50-60% of waivers are approved immediately and the overall approval rate is around 85%. Those are good chances especially when you compare it to places like Manila where the approval rate hovers around 10%.

You don't need kids to prove extreme hardship as proving extreme hardship is about proving how YOU will be affected, not your children.
