Hello all!

I'm a USC.

Married to my wife 2 months ago, she's currently here in the US with me.

Started the AOS procedure with her on the end of January, and got the interview letter already.

This is great, but...

We didn't have enough money at that time to start the AOS for my stepson (16 years old Down-syndrome kid),

therefore we received a Removal Proceedings letter, attached below.

My question is, can I start the AOS for him while he's on proceedings?

They didn't even set the date for the hearing as of yet...

Any other options?

We've got the money, but I'm not sure what to do.

01-07-2010---Married in the US

01-19-2010---AOS Package sent via Express Mail

01-20-2010---AOS Package received by USCIS

01-26-2010---NOA1

01-28-2010---Biometrics Appointment received

02-18-2010---Biometrics done

02-25-2010---Interview letter received

04-01-2010---Initial AOS Interview

I agree a lawyer is needed now.

** moving from "Adjustment of Status (Green Card) from Family Based Visas" to "Bringing Family Members of US Citizens to America" as you haven't decided which immigration path you wish to take yet**
