Working before Work permit is approved?? is that possible

Hello VJ'Rs

so here is my n my husbands situation...we are mailing out our AOS package on Monday..MY dad works for a farmer and my husband wanted to try some agriculture work a job had opened up and he filed out an application and it sounds really promising. it should take 2 months till we get the approved...what are the consequences if he took the job now...will he get deported does this happen often?

what wuld you do if this was your situation.

If he accepts the job and works there could be trouble for him and his employer as it is illegal to work before you get work authorization. Most times its forgiven when you get an interview but theres always the off chance that it might not be depending on your consular officer, or if there is a sweep looking for illegal workers there could be huge negative ramifications for both parties involved. Its safer to wait for his EAD and then start working. Thats why there is an EAD process in place, eitherwise anyone could just start working at any time they want.

In answer to what I would do....I haven't even started looking for work seriously (aka putting out applications yet) because I know I am not legal to work. I don't want to start my life here doing things that are against the law. He could always ask them if its possible to start once his EAD comes in.

No, please, don't do that!! And plus your husband needs to show the proof of work eligibility in the U.S. If you are sending a AOS package on Monday EAD card should come soon like in 1-3 months. Good Luck!

If we could all just look for jobs and take work right away, trust me, we would. I could REALLY use a job right now, but I CAN'T. I've even been offered brief 'cash' work for a family friend and I'm not taking it, because I don't want to have to lie in an interview, or risk anything for anyone. And TRUST ME.. we need the money.

Taking work illegally before getting EAD just makes the process harder on everyone who is trying to do things the right way. You're not going to find ANYONE here who would recommend illegally taking a job without getting EAD. In fact, doing so is against the terms of this website.

we just wanted to know what wuld happen and ask for input. we are not going to be doing this..we will be waiting till our time for EAD :)

Working without Work permit is ILLEGAL.Don't take risk

Hello everybody, my friend, I don't want to give you a bad or not suitable advice; however, I recommend you not do it. If you want to get the risk of doing under the table without any social security number and work authorization document is your problem; that depends on the work, on you and if you maybe can be busted by immigration doing that. It's like the case of the person who wants to cross a highway walking; it's possible but very risky and maybe you get busted you can be harm and lose everything. Now, in the worst of the cases that you decide to do it, you have to be aware of not telling USCIS that you were working, of course. I don't want to give you a criminal advice, but you take the decision of doing whatever you want that is risky or not. Thanks and bye,

It especially important, because the person likely to get into the most trouble is the farmer, and if your dad works for him it would be a double blow.
