Sinsot is usually given at a Thai wedding. Did you have a ceremony in Thailand? If so, was it registered at the Amphur?

I had SINSORT in Thailand. SINSORT meaning the money I have to give to her parent to get marry. I hope this is enough info about us.

It's not enough. There's nothing in what you have written thus far to indicate that there might be a problem, but that doesn't preclude a problem due to something that may exist but you have not mentioned. Remember also, sometimes problems can arise where none should exist due to errors on the part of the USCIS or the consulate.

You asked a question that really cannot be answered until the fat lady has sung.

Maybe there will be a problem, maybe there won't be. Hard to say, you do not provide all of the details about yourself and your new fiancee.

I have previously file I-129F in 2002. now divorced 2006 because of the Irreconcile differences.

DEC 2002 = NOA1

MAR 2003 = NOA2

OCT 2003 = VISA ISSUED, ARRIVED IN USA, MARRIED.

SEPT 2004 = SEPARATED (SHE LEFT ME TO CALIFORNIA)

FEB 2005 = FILED FOR DIVORCE

JAN 2006 = DIVORCE DECREE

Met my new fiancee in her native country in Nov 2005. Now want to file another K1. Is there going to be a problem? Please, need some good advice..Please help....all advices will be appreciated

Well, I am a USC. I met my new fiancee in NOV 2005. We spent 21 days together. we went places. My new fiancee is from Thailand. we talk everyday on the phone, yahoo, and msn. I met through a friend. Then we started to talk on the phone and see each other on webcam. I spoke with her 4 or 5 months before meeting each each other face to face. we have many things in common. I had SINSORT in Thailand. SINSORT meaning the money I have to give to her parent to get marry. I hope this is enough info about us.

PS: Now that we know she has adjusted status - yes, he will.

Well, I spoke with a immigration lawyer about my ex-wife. I asked him about the responsibility for my ex. the lawyer told me that if I am divorce. The affidavit of support I-824 IS VOIDED. I don't know if this is true or not. it just the lawyer told me. But I will know the truth very soon.

Billy neglected to tell us if his ex-wife adjusted status - one of the many details that he failed to provide.

Will he have a higher standard to show financial support for the next AOS if he's still obligated under the previous agreement for 40 working quarters or until the exwife gains citizenship?

That's what I figured.

I seem to remember the calculation for figuring household size included others you may have sponsored and are still responsible for.

We just had a small ceremony with people around her country home. They tied little thread around our hands and gave us blessing. I still have little thread with me. Heheheheehe. I don't know much about sinsot until I was asked by her parents. My fiancee told me it was a sinsot. you can called it ceremony. I am sure I didn't register at the amphur. I didn't know about register until now.

Read this... http://uscis.gov/graphics/publicaffairs/fa...eets/affaqa.htm . Unfortunately, being divorced does not relieve you of your obligations under the I-864 you signed for your ex.

That is good news about the wedding/engagement ceremony you had. If it was not registered at the Amphur it is not legal and should not cause you any problems with your K1.

The lawyer you talked to is wrong. The I-864 Factsheet on the USCIS website says ....

13. When does a sponsor's obligation to support sponsored aliens end?

The sponsorship obligation continues until the sponsored alien naturalizes, has worked or can be credited with 40 quarters of work, leaves the United States permanently, or dies. However, a sponsor or the sponsor's estate remains liable for any support or requests for repayment of benefits that arose before the support obligation ended.

14. Does divorce nullify the sponsorship agreement?

No, divorce does not nullify the sponsorship agreement.

So, as already mentioned by Yodrak, you will need to consider your ex-wife when you count your 'household' size to determine your income requirement.
