Hi everyone, plz help me here.....

My husband is on conditional visa which expires in july....what do i have to do to remove condition on his visa...also he will be stay in india from January to May n coming back in June...also going back again in july...for education..dose this gonna cause any problem with removing conditional visa..plz help me here....

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

i dont think so he can come back ......but does eveyone get the interview eventhough if u give them all doucments n eveything....also what the timefram for the interview...how long does it take after u fill for to remove conditional on visa ?

its rare to get an interview ,but it did happen and interviews are usualy chosen at random ,

no real timeframe as to know when the interview would take place if a interview is given ,

another thing is you have to keep in mind he will need another biometrics done

( they usualy give a bio date within 1 month of sending the file ),

sure you could ask for a later date but it would be USCIS choosing the date

There is no such thing as a conditional visa, except, perhaps, the K-1, which is given with the condition to marry the petitioning spouse.

IR-1 and CR-1 visa holders have no condition.

If you are talking about removing conditions from a Green Card that expires after 2 years, in your case I see a huge problem as Green Card Holders (we refer to them as Lawful Permanent Residents) are required to live in the United States permanently. It is not possible to live in India, whether for education any other purpose, and be a permanent resident of the US at the same time, as people have only one body.

In order to remove the conditions, prove of residency in the US has to be provided. I don't see how you he can do that if he lives in India and just occasionally visits the US in order to keep his status alive.

That is not exactly correct.

They only need to prove that the marriage was entered in "good faith", not that US residency was maintained suring removal of conditions. I would imagine they have the needed evidence they share the same US address/bills, etc...

With the info the OP posted, he hasn't hit that threshold. (It would be another matter if he goes out for 6 months, comes to the US for 1 month, rinse-repeat - that may cause some issues with ROC)

However, with that being said, if he goes beyond the 6 month mark of being outside the US (without getting the needed permissions to stay out longer), he may have issues with the green card status.
