Interview and Contacting Senator

So I went for my interview on 1/11/10 and a decision can't be made. I was told by the interviewing officer that everything should be fine and I should hear something in 3-4 weeks. That would put it around the beginning of February. So naturally when I didn't hear anything I contacted my Senator's office. He just called me back to say that my case is still under review and that it can take up to 120 days to hear back. Do Senator's offices have any pull? The representative did say that if I heard anything to call him back....I thought that was a little strange.

Anyone been though this? Any thoughts?

They can ask for a file to be reviewed but they cannot ask for an approval if the application is not yet approvable.

Can you please Elaborate more as to why the Decesion could not be made?

Was your application based on 3yrs marriage to USC? was it based on 5 years?

What evidence did they ask you to present?

What evidence did you take with you?

When did you receive your first Green Card? Was it in November 2008? If it was, that might be why you are experiencing problems. You are eligible for Citizenship, 3 years minus 90 days after the date you receive your Green Card(conditional card or none conditional) if you are still married to the USC. The date is not calculated by when you were married or the marriage anniversary but by when you received the actual card. Let us know if that's the case.

No I received my first green card in March/06.

All the Users here like this, Worried about their Visas then, their Creen Cards, then thie Chtizenship, i am wondering what after that needs to be worried about lol.

If you reported that arrest when applying for your green card and still received your green card, it should go through. If you didn't report that arrest when applying for your green card, but did for your N-400, you may have problems. It's never the extend of the crime that is important, it is being consistent from one application to another.

A lot of people think that question, did you ever commit a crime that you were never arrested for is ridiculous. Not so, if you were arrested for that crime, you lied on your application so you can be deported. Let's just leave this as a serious crime, not driving 56 on a 55 mph limit on a lonely road you weren't ticketed for.

Reason why I had success with my senator, wife's IO stated she should receive her oath letter within three weeks, I let seven weeks go by before I called my senator, wife received her oath letter via e-mail to me within three hours after making that call. Did you get a commitment? If not, the law says 120 days where you can take the USCIS to court if you opt to do so. Haven't met anyone yet that tried that, just waited, one as long as 14 months before she finally received her oath letter. It all depends upon how confident you are.

No Senators "Dont" have any pull, and im miffed of why people think they have....the only thing they "senators" can do is maybe check to see if your case is moving Forward.....and that is it....no more no less...

I see your interveiw was 1/11/10.....The uscis has 120 to reply to you.....so just relax a bit longer im sure you will hear something soon.

Sorry to hear about your continuing delays with your citizenship case. From what I see, your senator doesn't seem to want to help you there, which is unfortunate. If I were you, I would contact another elected official, such as a congressman and/or ombudsman abour your case. Maybe they can help you there too? As well, you might want to take it to a local media (tv, newspaper, etc.) if the delays get way too long...

Personally, I found that my congressman helped me out the best (lol..my senator was too far away), as they certainly did help me out with my I-751 case.....

And no, having an arrest with no convinction does not prevent you from getting citizenship...lying about it does....

If I were you, I would contact another elected official, such as a congressman and/or ombudsman abour your case. Maybe they can help you there too? As well, you might want to take it to a local media (tv, newspaper, etc.) if the delays get way too long...

Personally, I found that my congressman helped me out the best (lol..my senator was too far away), as they certainly did help me out with my I-751 case.....

And no, having an arrest with no convinction does not prevent you from getting citizenship...lying about it does....

I don't get it....what is not to understand about the 120 day rule....

USCIS will not be bullied into anything..by senators, congressman, Media & even Immigration Lawyers...
