Hello,

I'm really stuck on this part...

21. Your Household Size - DO NOT COUNT ANYONE TWICE:

a. Enter the number you entered on line 10. 1 **line 10 is 1 person because in Part 3. Information on the immigrant(s) you are sponsoring. I'm sponsoring my wife.**

Persons NOT sponsored in this affidavit:

b. Yourself. 1

c. If you are currently married, enter "1" for your spouse. 1

d. If you have dependent children, enter the number here. 2

h. Add together lines and enter the number here. Household Size: 5

Total comes out to 5 when in reality I have a family of 4

It seems I'm counting my wife twice.....

Any ideas???

Please see above. Simply reading what you posted you would see you did EXACTLY what it told you not to. This form isn't designed specifically for you. It's also designed if you need a joint-sponsor and said joint-sponsor is married then they will have a spouse and successfully not count them twice because they're not the person being petitioned for...

If you are filing K-1 , she is not your wife yet! So the answer would need to be 0 for (c.). I thought the form was confusing also!!! :thumbs:

If you are filing K-1 , she is not your wife yet! So the answer would need to be 0 for (c.). I thought the form was confusing also!!! :thumbs:

He isn't filing FOR K1, he's filing AOS FROM a K1. K1's use form I-134 when applying for K1, K1's adjusting status (once in the US and after marriage) use form I-864. So he IS married right now.

Noooooooooo....so sorry.....this is for AOS and we are now married. She came in as a K1.

Well normally you would. I know it seems strange and like you're lying but like i said before, if you had a joint-sponsor they would ALSO use this form and if that joint sponsor was married then they WOULD put a one there.

As the first part says "DO NOT COUNT ANYONE TWICE" then that's the rule to follow. Trust me. Enter a 0 for your spouse in that section (they really should change the form up, i know :S)

I reviewed your timeline, I could not tell if or when your wife received her visa. I think if you update the timeline you might get better answers! When I replied I was going by your filing status shown on your post. Sorry if I was wrong!

The reason the previous poster was confused was because you still have your profile info listed as "K1". To change it go to your control panel and on the left it says "change profile information" click on that. Then scroll down to where it says K1 and change it to "AOS (pending)". :D

also, please update your timeline so other people can benefit from your experiences/timeline and so people can give you proper advice for your situation :D

I apologize if I misled anyone but thanks for all the info. I have now updated my timeline and changed the marreid part to zero....
