My wife would like to request work authorization while she waits on her green card to process

From the day you submit the green card forms, pictures, etc etc , how do you request temporary work authorization and how soon after the green card forms/files submission, does that temporary work authorization become active?

Will it just be another SSN looking card, like the one she had when she was here on her visa? Thanks for reading.

it's form I-765. It is active once she gets the card, the card can take up to 3 months to arrive... sometimes sooner. it's filed WITH or AFTER the AOS submission (it's better to send it with)

Thanks for your response, I had thought the temporary work authorization would bridge the gap from filing time until the ~90 day mark, I didn't realize it WAS the ~90 day related work authorization and meant to bridge the gap from ~90 days until the receipt of the green card.

90 days is a long time, is there anything that can be done in the mean time? Can the old work authorization card be used or activated?

If you have the NOA1 from the AOS petition, you can send the I-765 stuff off now with a copy of the NOA1 from the AOS. It may, or it may NOT arrive before the GC does but it certainly can't hurt to try. As it's being filed due to AOS then the fee is waived.

Here are the requirements for sending:

--EAD--

- G-1145 – Form for E-notification of Application/Petition Acceptance

- I-765 - Application for Employment Authorisation **See Note 1**

- Photocopy of NOA1 from AOS application

- 2 passport photos (US passport size) - name and alien number printed lightly on back in pencil or felt pen

- Photocopy of passport biographical details page **See Note 2**

- Copy of I-94 – Arrival/Departure record (front & back)

- Copy of Marriage certificate (to show name change) **See Note 3**

Note 1: Being adjustment applicant's, we're under category c9. You will see there's also a category for K1 and K3 visas (a6) but this is for when you're not applying at the same time as the AOS.

Note 2: It actually says "If no prior EAD has been issued, you must submit a copy of a Federal Government-issued identity document such as a passport..." as well as some other examples but personally I think the passport is the easiest one.

Note 3: The next issue for me (being female, married and changing my name) is my passport is still in my maiden name. For that reason it seems to make sense to include a copy of my marriage licence. :D

Like I said above (but it bears re-mentioning).. it might NOT arrive in time. She cannot work in the meantime but if she gets the Greencard first then she CAN work. The EAD is just supposed to be while you're waiting for the GC to arrive.
