ds 230 question?

ok i'm looking over the ds 230 part 1 form I am wondering if the answer to question 40b

should be yes or no my fiance was convicted of possession of an illegal firearm but i consulted an immigration attorney and was told that that in and of itself is not a crime involving moral turptitude. Anyone have any experience with anything like this?

Timeline

Jan 8, 2010- I-129F sent to Vermont 10:16 PM

Jan 13, 2010-arrived at VSC signed for by D RENAUD 11:41 AM

Jan 14, 2010- NOA1

Jan 19, 2010- Check Cashed

Jan 21, 2010-NOA1 hardcopy received

Jan 19, 2010-Expediate request medical and financial reasons

Jan 28,2010-New Expediate request since customer service agent did not submit correct info with 1st request

Jan 29, 2010-Received email from Vermont requesting evidence to support expediate request

Feb 11, 2010-Received letter via mail from USCIS stating expediate request was approved. Letter dated 2-4-2010

Feb 12, 2010-I129 application approved

Feb 15, 2010-Received email stating application approved

Remind me again, what is the question on that form?

Possession of an illegal firearm is not involving moral turpitude.

Life's just a crazy ride on a run away train

You can't go back for what you've missed

So make it count, hold on tight find a way to make it right
