Hello everyone,

HELP PLEASEEEEEEEE

I am Canadian and I married a US citizen and applied for change of statuse.

almost 10 years ago I had been charged with shoplifting under something like $50 dollors , I never been arrested but they send me a letter to attend court . the disposition of the court as I remmber was either community service or donation , so far I remember I paid $150 donation and the lawyer said my case was dissmised.

when we were filling Form I-485 we decided to put No as answer in criminal record section of the form and then we were going to speak to our lawyer to see what do we exactly have to put in that section .

The day of appointment with our lawyer we got very tied up to providing her with other information that we completly forgot to ask her about that and she submit the application that way . basicly the correction never been done.

I recently received the letter for my interview and they asked me to provide them letter from the court , that's when we remembered that we never changed the information in that section of the form.

now my question is , how much trouble am I in for this big mistake ? are they going to deny my application beacuse of this mistake and the fact that I did have a criminal record?

can someone please helpppppppppppp

Sounds like it could be seen as a misrepresentation of the facts if they were to find out.

The first reply you received in the previous post answered your question in detail.

You put "no" when (from your own post) the answer should have been "yes" and you should have known quite well from reading the question and the corresponding instructions what the question meant so they wouldn't accept "I didn't understand". This is typically considered material misrepresentation and carries a lifetime ban (meaning, as the previous posts response said, denial and then you will never be able to apply again). I say typically because there is no way to know for sure and all cases are different.

Get the information they requested and be prepared to explain.
