hi guys

really need ur advice to calm me down ,,i came to usa 10 years ago on tourist visa,,applied for adjustment of status 7 years ago..havnt got my green card ,,,,yet,,,,sadly,,,

it still in processing,,,lawyers said 'nothing to do except ''''waiting''''

i want to go back to my country egypt,,to get married and come back

i have advance parole now the question is;

am i subjected to be denied at the port of entry? even with vaild advance parole?

does it mean -if denied-i wont be able to enter usa forever?

will my case in immigration will be closed or still going?

how long can i stay outside usa and return with advance parole?

please help me,,im really worried about losing every thing just by leaving usa for 1 or 2 months

7 years is quite a long waite ,

is your advance paroll still valide ( it has an expiration date of 1 year ) did you renew the advance parolle

did you contact your congressman and did an info pass ?

why would you be denied if you have a valid AP...thats a legal document that allows you to come back to US...

Also 7 years waiting for a GC is a long wait...maybe you should try something else..infopass...

The I-131 (instructions) explains some reasons why you should use AP with caution (see I-131 instructions Page 3, section 3). It does not guarantee re-entry to the US. (For most maybe, but not everyone.)

Lots of missing information here. Why is it taking so long to get your green card?

AP is not a guarantee of admission to the US. Check the expiration date on it and I would be running to an info pass appointment to find out what is going on with your case. Sounds to me like your attorney feels he has "done his job" and has no further obligation to do anything for you. My case we were calling about his green card as soon as it hit the six month mark.

Best bet, get copies of everything from your attorney and start working this case yourself. I wouldn't leave the country until I found out what was going on .

i was busy in the last days with attorny ,,they try to find sht in the law to make my papers go faster,,or even keep my right in the case if i got denied

well,yes,,7 years of waiting is too long ,,,first imin newyork,,they always say its too busy and has millions of green card applications,,,

second,,i put my case sponsoredthrough work,,,not marriage or family

they say it takes time

if sponsered through work,,,and faster if through marriageto american citizen

third,,im arabic person,,,we ''arab ppl'' they think always bad about us ,,even the good ones

i just had my advance parole two months ago,,means very much vaild

If I may ask - what was the reason you used to apply for the AOS from a visitors visa? That would be important on any other advice given. (Did you switch to a work visa? if so, did you do it before your I-94 expired?)

Looking at your "timeline" you posted, you came here 10 years ago on a visitors visa, applied for AOS 7 years ago (so that means you have more than an year "overstay" from your initial entry into the US - at least 2 years, 6 months), so even if you have a valid AP, and even if you are in the process of AOS, you would most likely be denied entry upon your return to the US, and subject to a ban (10 years is my guess, if my math is correct).

Don't leave. I am sure your lawyers would tell you this.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I agree with Bobby + Umit. There appears to be a period of time where you may have been out of status. When did your visitor's visa expire? When were you sponsored for an employment visa? If there were more than 180 days between the time the I-94 you received when you entered the US expired and when you received the EAD for your sponsored employment then, even though you have an AP, you cannot safely leave the US as doing so would trigger an automatic ban -either 3 years or 10 years depending on how many out of status days you accumulated. USCIS will issue the AP even if you can't use it because it is the border authorities who decide whether or not you will be allowed to re-enter the country.

If you had an overstay of more than 180 days prior to applying for adjustment of status, you will trigger a bar from reentry when you exit. The term of the bar will depend on the actual amount of overstay. Advance Parole does not exempt you from the bar and you would not be allowed reentry.
