CR1 Visa petitioner staying in Philippines

I think the only problem would be proof of the ability to support. He has a domicile with his father in the US...not the first person to give their domicile as living with parents/relative.

I assume your family or someone else is willing to co-sponser?

DID YOU TRAVEL TOGETHER AND THEN COME BACK TOGETHER IN THE PHILIPPINES?

If he didn't, that means he gets not Balikbayan stamp, and if he has overstayed = screwed

Big fines or deported/blacklisted

That visa requires he travels to the phil, and then him and his wife, leave the country together, then return, even if its only for 1 day

My wife has an interview date at the Manila embassy on April 13, and I have been staying here with her in Manila since February 26, 2009 on a visitor visa.

We both plan to return to the US when the visa is approved.

My question is: will me being here for that amount of time cause any complications? I still have residence in the US (I live with my father (I'm only 21 years old)).

This is from the embassy in Manila

"Attachment is for your information and compliance. Due to domicle issue, you have to return to the U.S. once the petition is approved before an immigrant visa could be issued to your wife. USCIS Manila accepts petitions by mail; however, we only accept U.S. postal money order for payment via mail."

Maybe I should have mentioned I am working remote here for a voice over IP company in the states. Technically however I am not working here as I have

no work visa and the company I am working for technically shouldn't be allowing me to work outside the country (I think you need some kind of license) but I did file US taxes this year and last year. I have no co-sponsor.

Weather your company breaks the law or not really isn't thier concern, you are the one on the hot seat, you filed taxes with no questions asked your golden, the embassy and USCIS just isn't concerned if you the USC broke any NON - US laws or not, your wife is a differant story.

What? :wacko: Did you really take the time to read the posts? Your way off on this one!

That post came out wrong here is what I was trying to say

When you arrive in the phil on a tourist visa, its 21 days, you can get an extension, you have to pay for, and go for much longer.

If you are married to a philippine citizen you can get a balikbayan visa stamp. This is only if you are married and you are your spouse leave the philippines to any other country, even if its only for 1 day and return together, as long as both passports have the same last name, and best to bring marriage papers just incase.

If he has stayed over the 21 days, not extended, and has not done anything, then he is overstay, its a big fine, and after so long he might be deported or blacklisted. He needs to do the right thing and get legal
