CR1 Visa petitioner staying in Philippines

My wife has an interview date at the Manila embassy on April 13, and I have been staying here with her in Manila since February 26, 2009 on a visitor visa.

We both plan to return to the US when the visa is approved.

My question is: will me being here for that amount of time cause any complications? I still have residence in the US (I live with my father (I'm only 21 years old)).

Your visa to be in the Philippines is typically 21 days as a tourist. So unless you paid for and recieved a 59 day visa you can have issues leaving the Philippines. You can apply for the longer visas in the Philippines.

No, I have no issue with Philippine immigration we are married so I get a special visa.

My problem is, I am worried that my stay of one year here will affect the visa process.

If you are married to a Philippine citizen, you are entitled to a balikbayan visa good for 1 year rather than the usual 21 days.

If you are married to a Philippine citizen, you are entitled to a balikbayan visa good for 1 year rather than the usual 21 days.

OK I am not concerned with any Filipino immigration issues. My question is:

I have been staying here for a year. Will my wife have any troubles getting her US at her US visa interview because of this? She is going in for a CR-1 visa. I know there is a

If you meet the requirements of the I-864 (domiciled in the United States, or its territories or possessions) and ( demonstrate that your income is at least 125 percent of the current Federal poverty guideline for your household size.) and your employed or self employed, you should be fine.

The question about your one year stay may never be ask, at the time of interview?

You should have been able to prove your domicile during the process unless you didnt tell the full truth on the I-864 :whistle: . You do have domicile in the US though...your father's house (I am assuming he did a co-sponsor?) You should have no problems though. A letter or affidavit from your dad might help if the question ever arises and he didnt fill out a I-864A (i am assuming you will live with your dad for a little while once getting back to the US)

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Temporary Resident Visa

I am married to a Filipina. Under your regulation I am a restricted national, will I be eligible for a permanent residence visa?

No, However, you may apply for Temporary Resident Visa (TRV). This is issued to an applicant who, despite the absence of immigration reciprocity between his country and the Philippines, contracts a valid marriage with a Philippine citizen.

Who are qualified for TRV?

An alien spouse and unmarried children under 21 years old of any Philippine citizen may apply for TRV.

What is the validity of my TRV Visa?

TRV is valid for a probationary period of one (1) year. Thereafter, it may be extended every two (2) years.

What are the benefits of a TRV holder?

Once you have this visa you may now:

* be employed in the Philippines

* lease real property

* own personal property

* qualify for Philippine citizenship, after residence of five years

Think about all of this from the I-864 standpoint, ya?

if you (plus a co-sponser) meet the financial guidelines, and this is noticed on interview day, then you should be ok.

re: domicile requirements - you've maintained that through your father - but you might want to cover your domicile stuff in an updated evolution of relationship letter.

yer situation is a bit unique, but others have done the same (to wait in foreign country whilst the visa paperwork winds it way through).

suggest you do a search here, in the CR-1 forum, using 'domicile' as the search term, using the 'big search' thingie -you'll find others's experiences about what they did.

That is incorrect. NVC DOES evaluate domicile - my second RFE was for proof of re-establishment of domicile.
