Hi

My name is Kim. I came to the US when I was 14 yrs old with a Tourist Visa, it expired when I was 17, I got married to a US Citizen last year. I am really lost of what to do, as far as I read I need to fill out the I-130? Don't know if I'm correct. I would really appreciate if someone can help me, when been married for over 2 months already...I need to get this going in case of an emergency. I'm in this country by myself, my entire family is in my country and I haven't been able to see them since I was 14.

Please help me! I would appreciate it so much!

Hi Kim! Start by reading the guides here --> http://www.visajourney.com/forums/index.ph...page=i130guide2.

I'm guessing you are 18 or older now and legally married. I'd suggest reading the forums here, as there are many of us going through this process. Get your husband to help you when you fill out the forms. It can be quite daunting and it's a great bonding experience. You will be so happy to see those forms get mailed off. You will need to mail the I-130, I-485, I-765(employment authorization), and I-131(Advanced Parole). However, there are a few other forms that are included in these main forms (I-693(Medical), I-864(support/income guidelines), and a few others. Be sure to read the guides carefully.

For the medical, you'll need to get a record of your vaccinations from back home if your parents are able to obtain those for you. You will also need to go to a Civil Surgeon to get everything else caught up and checked off.

You will get a lot of responses to NOT go home, if you want to stay here and go through Adjustment of Status. Once you leave, you'll trigger a ban. I don't know how long tourist visa are valid (I know that i've seen most around 6 months...not three years like you said you have.), but you said it's expired, so you'll receive some kind of ban depending on the length of your overstay. However, if all goes well for you in the AOS process, this overstay will be forgiven. :)

Also, when looking at forms, be sure to download and use the forms from http://www.uscis.gov !!! They have just updated the I-485 and they have adjusted some mailing locations, so be sure to get the most up to date information there!
