working 'abroad' prior to EAD

Hi,

I know a beneficiary cannot work in the United States prior to getting an EAD.

I am not clear if this also includes the beneficiary remaining on the payroll of his previous employer and working virtually , in a counsultant capacity, while physically living in the USA.

For example, he has worked for company X for 3 years, and much of his work is done online. He is offered an opportunity to continue the online portion of his job description, although he will now be in the USA. The funds would continue to be deposited in the original bank account from the country of origin, and not withdrawn for use in the USA, but rather remain on deposit for visits to parents and such.

Any thoughts?

The EAD is just about working IN THE USA. Has nothing to do with working overseas so it's a non-issue.

Yes my wife remained on the payroll.
