On the AOS we just use the maiden name of the applicant? Also we tried to change her name at the SSA office and she said we have to wait for homeland security to okay it? That she goes by whatever they go by. We have gotten married and everything and she has a SSN in her maiden name. We were trying to change it. Do we have to wait till she gets her green Card? She is from Canada and is trying to get a green card to live here in the USA with me.

If your wife wanted to take your last name, she should have used it on the AOS forms. The green card will be issued in whatever name is on those documents. *Edited to add - what's done is done now though. She'll have to submit form I 90 once the green card is issued to get it changed. If you end up interviewing for the green card, you MIGHT ask them if they can change it there, but I'm not sure you'll be successful.*

In regards to the SSN - assuming she entered on a K1, she could have gotten it in her married name. All they need immigration for is to validate her immigration status, not what name she has on file, esp. as K1ers tend to change their names! She should be allowed to make the change simply by showing your marriage certificate. It sounds like the office you went to doesn't know their own rules.

And on her SSN it is her maiden name. But she wants to change it to my last name. So we file the AOS in her newly married last name. And than we can change the name on her SSN to my last name? Is this correct? (She already has an SSN in her maiden name.)

Yes that is correct. She should file the AOS forms in her married name.

AOS timeline:

1st March 2010 - AOS packet received at Chicago (I-130, I-485, I-131, I-765)
9th March 2010 - Checks cashed
12th March 2010 - All 4 NOA's received
19th March 2010 - Applications touched biggrin.png
19th March 2010 - Received Biometrics letter for 2nd April
2nd April 2010 - Biometrics done
19th April 2010 - Received interview letter for May 21st biggrin.png
6th May 2010 - All applications touched. Status of I-765 changed to document production, status of I-131 changed to post decision activity.
10th May 2010 - Received approved AP in mail
21st May 2010 - AOS Interview, IO said he will approve the case... waiting for Green card smile.png
27th May 2010 - Received EAD card
17th June 2010 - Approval notice for I-130 received. Also received "Welcome to USA" letter biggrin.png
28th June 2010 - Finally received my GC.... Praise be to God smile.png

16th March 2012 - Sent ROC package
21st March 2012 - NOA1 date
20th April 2012 - Received Biometrics letter for 16th May

December 2012 - Received 10 year GC

01 Nov 2013 - Sent naturalization package

18 Feb 2014 - Oath ceremony done, naturalization complete!!

Thanks for all the help, visajourney has abeen our best friend in this process. Its crazy how SSA officers don't understand their own rules. I work for verizon and if I didn't understand the rules I would've been fired. Its crazy how the government isn't as thorough as some organizations.

Ask for manager. SSA should change the name on the basis of marriage certificate.

I ran into the same problem at the SSA when I tried to change my wife's name on her SS card to her new married last name. The clerk said to wait until the Green Card or EAD card came with the married name on it and then to return to the SSA office to have it updated at that time. For the AOS process, we used her married name and all the NOAs we have received to date from USCIS shows her married name.

I just changed my name at SS office last week and I was able to change my name without any problem.

Ex) Old name which showed on my SS card: Mary (First Name) Smith (my maiden name) no middle name

Husband last name: Dixson

After got married : Mary (First) Smith (Middle) Dixson (Last name)

I brought my Certified copy of Marriage Certificate and Passport. I also filled out SS application form. Whatever you write in application form, they can make changes for your SS card as long as you have sufficient documents. I did not have middle name before married but I wanted to add my Maiden name as middle name, so I put my maiden name in middele name section and they did for me.

On the same day, I sent USCIS to file my AOS.

So I do not think you have to wait until you get your GC.

Current Status : Permanent Residence

01/17/2010 Engaged

02/20/2010 Married!!

Sent Documents: I-130,I-485,I-693,G-325A,I-765 and I-864

During our AOS interview the officer asked her which name she wanted to use. She said her married last name, and that is what the officer put on her green card.
