Hi everyone!

This is my second post, but as I didn't get any replies :( I thought I would post again. Maybe my topic title wasn't eyecatching enough!

A bit of background:

I got engaged to Phylis at Christmas and she (the US citizen) applied for a K1 in January. On Feb 19th she received the approval (NOA2?). I understand that this will now be passed to the US embassy in London.

So I have a few questions:

How long does it usually take for the London Embassy to schedule an interview?

I have 3 trips booked to visit the USA in the next few months (beginning of April, mid May, and then end of July - for a family holiday with 2 of my daughters) What happens if the interview is scheduled before any of these planned visits? Can I still travel on the Visa Waiver scheme?

In April we are thinking of buying a property (off plan). Is this OK?

Once we get married, can I return to the UK before I move out permanently? How long does it usually take from the date of the marriage, to receieve my Green Card?

hi key and phylis your question about interview schedule

it will usually take minimium 2 month and maximium 3 to 5 month but in my thinking it will take minimum 3 month

if your interview confirm and schedule and you are out of country

no problem you can call embassy and email them please reschedule and extend my interview date iam in usa for my holiday vacation the embassy have no problem to extend your interview but remember you have solid reasons

yes you can still travel on the visa waiver scheme without any worries but make sure you have strong ties proof and evidance that you have intend and return back to uk

and you have also solid reasons in case if border officer ask you

1 what purpose are you going there

iam going to my holiday vacation

2 are you plan intend to live there

no my plan intend to return back to uk because of my k1 interview with usa embassy in uk

once you finally got your k1 visa you go us and marry your fiance when you finally marry your fiance you have no problem to come uk but remember your k1 visa is only valid for 6 month if you bare not return in us in 6 month your visa will be expire but i suggest you before you move permanently to usa complete your all work in uk then you move permanently it is better for your future

yes you can buy property it is better for your visit visa traveling and your strong ties and proof in uk

and your question about green card your green card process in usa take hardly 6 to 7 month

According to the immigration timelines, you're looking at about 80 days until your interview (which is great!). You can still travel, but like mustafa1232 says, bring ties to the UK and an interview letter is a good tie, showing you are going to return to attend.

Remember, once you marry within the US, you cannot leave until you file AOS and get your AP (advanced parole). This will allow you back into the US after you leave.

Then you will have been considered to have abandoned the petition and it will be cancelled and you will have to undergo everything again. You can reschedule the interview or you can make it a higher priority and not travel.

Can I still travel on the Visa Waiver scheme? Maybe so and Maybe no; all depends on the CBP at the POE.

In April we are thinking of buying a property (off plan). Is this OK? NO effect on the visa process.

Once we get married, can I return to the UK before I move out permanently?

Yes you can leave anytime, but if you leave before you adjust status, meaning have the AP or GC in hand, then you will have been considered to have abandoned the AOS process and all will be cancelled and you have to do everything from the beginning again. Without the AP or GC in hand, you will not be allowed to re-enter the US. You can leave at any time, no restrictions to that.

The highlighted text above is only partially correct. The K1 visa is valid for six months, but it can only be used to enter the US one time. You cannot use the K1 to enter the US, get married, and then leave the US, hoping to use the K1 to reenter. If you don't get a green card or AP before you leave, you won't be able to reenter.

Because the OP is from a visa waiver country, it may be possible to enter the US with a K1 visa in the passport without actually activating the K1 visa, using the VWP instead. Some people have said the CBP allowed this, while others have said it wasn't allowed in their case. If you decide to try this then make sure you have a backup plan before you head for the US. If CBP won't allow you to use the VWP while you've got a K1 in your passport then you'll either have to use the K1 (and get married and remain in the US until you get a green card or AP), or you'll have to turn around and head back to the UK. Just remember that you CANNOT get married until you enter with the K1. If you marry while visiting on the VWP then your K1 will become invalid.

I would suggest you don't enter with the K1 visa until you're ready to get married and stay in the US for several months minimum.
