I just mailed my I-129F packet (two days ago) and haven't yet received first NOA. My fiance has already bought a ticket to visit for one week next month, not realizing that he should not vist during the process. Can anyone tell me if he might have trouble getting in? I'm hoping it will be ok since we are so early in the process.

I'm hoping it will be ok since we are so early in the process.

Lots of people on these boards visit each other during the process. You just need to keep things like boarding passes/plane stubs any evidence of visits as these may be required later on. Remember dates as you may be questioned about visits at the interview....

The tough thing about visiting during the K1 process is that your fiance needs to prove that he really intends to go over for just a visit and will be returning home to finish the visa process. He should bring evidence to the airport of this. Something like an apartment lease, a job contract, etc. Anything that proves ties to the Netherlands. I think that you should be fine, I don't think he's coming from a high risk country or anything, so I would think that he should probably be ok, but be prepared for the possibility that he will be turned away because they think he intends to bypass the visa process.... Good Luck!!

its totally up to the officer when he trys to come thru. Make sure he has lots of ties to his country. Be prepared to answer questions truthfully. If they ask who he is seeing tell them the truth, don't try to hid the fact that he is engaged to a US citizen.

I had a horrendous time trying to cross and was denied, but others were luckier.

If he does get denied entry , don't worry. It will be fine. They will have record of it when he goes for his K-1 interview and most likely ask about it. They did at my interview but they guy said its quite common and nothing to worry about. I got my Visa regardless.

For gods sake of course he can come and visit you....its a free world and also the fact that immigration have no idea that you are going through this process.....their computers say nothing.Dont listen to the people on here who get all worried and negative about this.I was over in the states only 2 weeks ago and i was approved while i was there so it goes to show they have no evidence that you are applying for a fiance visa............

I am affairs I must disagree about the last post, of course the officer will know and if you lie about the purpose of your visit you will get turned away, follow the other advice, bring plenty of evidence of ties to your home country, be relaxed and if possible fly via shannon, ireland, where you will go through us immigration.

I visited my future wife with no problems, just play by the rules as it is at the discression of the officer on duty

I went over to the USA at Christmas, and apart from being asked where I was staying and where I met my Fiance, I was not asked for return ticket, or evidence of ties in the UK. But I did take them with me, and my advise would be, take as much evidence of ties as possible, eg., letter from employer, bank statement (recent) utility bills. But I think you will be fine

to answer your question...yes. he might have trouble getting in. it's hard to say exactly when it will show in the computer that you've applied for a fiance visa, but it *will* show. at that point, it is up to the discretion of the officer at the border.

when my husband and i were in the process, we found it much more logical for me to travel to the UK to visit him, rather than the other way around. we didn't want to risk losing the money spent on airfare in case he were to be turned away at the border. it may be worth it for your fiance to consider getting a refund or credit for his air fare, and instead flying you over to visit him.

of course, that's just my opinion.

i know there are many here on VJ who visited during the K-1 process with no problems. however, i also know there are many who were turned away at the border. it depends on if you are willing to take the risk.

I have visited three times throughout the process without any problems. But as a backup I have had letters from my employer in my pocket on each visit as well as copies of bills etc. I always keep the little US-VISIT receipts on exit from the USA as well. Those I can tie up with each entry stamped in my passport to show that I have never outstayed.

I also never give them more info than they ask for. When they ask purpose of visit? I reply to visit my fiancee for a week or so. No more than that, no life story. Just answer the questions honestly and I am sure there will be no problems.

Here's our experience...

My fiancé is Italian. We filed our K1 on 12/30/05 and shortly thereafter received NOA1. He flew from Barcelona to Los Angeles on 1/20 for a 7 day visit. He had no problems at the POE. They did not even ask him questions as they had done on his previous visit. (How long will you be here? Who are you visiting? -- questions asked at LAX POE when he visited 11/05). However, because we had already filed the K1 he brought the following documents with him to prove his intent to return to BCN:

*letter from his employer stating he was to return to work on 1/26

*work ID's

*paycheck stubs

*his job contract (states his salary, start date, contract expiration date, renewal option, etc.)

*bank statements

*phone bill in his name

*Round trip ticket

If he has a mortgage or rental agreement, that would be good to bring as well.

There is no rule or law that says the beneficiary cannot enter the US with a pending K1. However, his admission into the US is at the discretion of the POE officer. Basically, the beneficiary needs to prove he has ties to his country and has the intent to return to his country. Also, honesty is the best policy. Whatever they ask him at the POE, just be honest. Being that he is from a VWP country, he should not have any problems. Have a great time together!!!

I came to be with my fiance in the US for a few months after we started the K-1 process. I brought some documents with me to show my intent to go back to my country (a bank account statement and a letter from my employer), but I was never asked at POE about it. All they asked is where I'm going to stay and what's the purpose of my visit, I said I'm visiting my fiance and going to stay with him. That's all.

But then I heard of many stories of people who weren't as lucky and the officer at POE decided not to let them in. So it really depends on what kind of officer you stumble upon. Good luck!
