filed I-751 in October 2008, still waiting

you can see most of my early timeline below in my signature.

as for the I-751, i filed it in Vermont in October 2008. i was sent to the nearest USCIS office in January 2009 to get fingerprinted. in April i got a noticed that my file had been transfered to California. in August i think it was, i received a request for evidence, which i sent back to them a few weeks later.

i didn't hear anything back from immigration for months, so i called in December 2009. i was told my case was outside the normal processing times and that they would put in a request to push it through. a few weeks later i got a letter saying the processing of my case had been delayed and that i would hear back from them within 45 days. i didn't, so i called again in early February 2010, they didn't have any new information, except that my case had now been transfered to an adjudicating officer.

i just got a letter in the mail today, conforming that they had indeed received my answer to the RFO back in September 2009, but that my case was not ready for a decision as the investigation into my background remains open. the letter says to wait another 90 days, and if i don't get a decision or NOA to contact them again.

has anyone experienced anything similar?? wouldn't they just send me another RFO or schedule an interview if there was anything they weren't sure about? i'm really at a loss here and am getting worried...

August 3, 2009: received RFE letter; sent in evidence 2 weeks later, USCIS confirmed reception

March 03, 2010: Filed form DHS-7001 with CIS Ombudsman, and contacted my local Congresswoman to try to get my case pushed through.

June 5, 2010: Letter from CIS Ombudsman telling me USCIS is not ready for a decision yet. They didn't give me a timeline for when to expect a decision... this is getting worst...

August 2, 2010: Infopass appointment for I-155 stamp in my passport. Agent who helped me is going to get my file from California and process it himself!

August 10, 2010: Email from my Congresswoman's office, USCIS still not ready for a decision, told to wait another 90 days. And email from agent at local office telling me that his request to get my file was denied by California...

I dont realy have an answer for you but wanted to say

if you are planning to go for NATS ( US citizenship ) you are eligible now

since you have been resident for over 3 years

you could apply for it and it would eliminate the GC aplication once you get the US citizenship

( GC residents are eligable to apply for NATS if still married after 3 years

if divorced the waite time is 5 years ) good luck

Agreed - I would also apply for naturalization if you've planned to. It will 'force' adjudication of the I 751.

If you don't plan to apply for natz, I'd seek help from my senator/congressman.

thanks for the answers. no i have not planned to naturalize, so that is not an option.

what should i say if i contact my congressman? are they really that helpful in these situations??

They can shake things loose sometimes by putting in an inquiry. Just tell them your time line (as you've laid it out to us) and what the latest status is (basically stuck in some sort of limbo) and let them run with it.

Most senators/congressman's offices have a specific immigration liaison and the service center's have a team that does nothing but respond to their inquiries. In fact, I believe they're required to give a 48 hour turnaround on most requests (at least that's how it was when we used ours) - at least give them some sort of information.

I feel your pain. I have have been waiting since June last year. I know its not as long as you but I am frustrated either way. The only consolation is fellow VJers who had similar experiences. I have put a link that I found useful, there was another one too about people that had been waiting over a year for i751s I cannot find it. Maybe if you keep searching you will find it.

vegan girl SINCE you filed jointly you are eligble to file for citizenship, like you said your application is stright forward nothing out of the ordinary so why dont you file for citzenship that way your case will be approved quicker?

mainyasha, thank you, it is reassuring (but also unfortunate) to know that there are others in my shoes. i wonder if there are people who have waited over a year to have their ROC approved that might be able to shed some light on why it took so long for them. i just don't get it!

rnqueen, as i said previously in this thread, i am not interested in becoming a citizen of the US, so that is not an option for me.

bradcanuck, glad to hear they helped you! i think i might call my congresswoman tomorrow. what did they do for you, would you mind explaining? i am not sure what to expect when talking to them, and what kind of timeline i would be looking at to see anything happen with my case, etc.

I feel your pain! I filed my I-751 in December 2008 and, like you, have been getting the runaround ever since, even though my case is very straightforward. I'm now on my second I-551 stamp! In the end, I just filed for citizenship when I became eligible in December 2009 and now have an interview scheduled for April.

No longer having to be at the mercy of the USCIS was one of the main reasons I decided to file for citizenship. Perhaps you should think about that before you completely dismiss becoming a US citizen.

As a permanent resident you will never enjoy the full rights afforded to citizens, and if you intend to live in the US permanently, wouldn't you want to have them? I've lived here and paid taxes for seven years now, so I strongly feel that I should. (And luckily for me, I don't have to relinquish my UK citizenship.)

Anyway, good luck. Hope things work out for you.

Normally they give a usual BS like background check to cover up..as suggested please contact your congressman at the earliest ..wait 90 days what the hell , you have bene waiting for 2 years now...

Another suggestion si write to the district director of your DO and also the CIS Ombudsman , you can also write in your letter to the district director that you are considering filing a writ of mandamus against the USCIS , you may send copies of all documentation.. try it out , you mat not even have to wait 90 days.. sorry to hear that you have been getting the runaround too. i have my own reasons for not wanting to become a citizen, and that will not change. as a permanent residents, i have all the rights that i feel that i need. my father-in-law isn't a citizen either, and he served in the military, he has veteran status and the benefits that go along with that. he is about to retire and will be getting social security just like a citizen would. i don't think he is missing out on much, other than voting. anyhow, that's just my opinion, i understand why others want to naturalize, and that's respectable. its just not what i want.

nycguy78, i am going to call my congresswoman today. as for writing to the district director and to CIS Obulsdman, could you explain? i am not familiar with that process, or who these people are even haha thanks in advance!
