Are there new tuberculosis requirements for AOS?

Hi all. Aos interview is coming up on the 18th of March and I want to be prepared. My wife had a medical done less than one year ago(April of 2009) in Mexico and a chest x-ray was done. I keep thinking that I read somewhere that there is a new test that has to be done and that her ok x-ray in 2009 isn't sufficient anymore. Anyone know if it is possible that the officer may ask to see some sort of TB test result or would there have been a RFE sent if they didn't have all the required medical information from the overseas medical?

I was told (and through research here on VJ) that if a previous medical has been done less than one year to one year of filing for AOS, that another medical is not necessary because the immunizations for the first medical had to be up to date to begin with, which for myself included the TB test. When I entered the US I was advised by my lawyers to get a medical done by a civil surgeon just incase. So, that's what I did.

I too think that an RFE or some sort of notice would have been sent to you if the information you have already submitted regarding the medical would not suffice.

I was under the impression that questions regarding the medical would not be brought up during the AOS interview. Hopefully someone who has had a similar experience will be able to clarify things further for you.

I sort of thought that too at one time. I think it goes in cycles because people don't hang around and help out AOS-ers so much like they do K-1s. Probably because there's not a large gap between K-1 and AOS, I think, but after AOS, nothing to think about for 2 years....So rumors tend to go in cycles.

Anyway, back to topic - The TB skin test change came in 2008 or so. It's NOT a new requirement. The thing which changed is that there was a newer type of TB skin test allowed, not that it was suddenly required for AOS. Even since the uptick in medical RFEs, people have been approved without having to get an extra TB skin test from a CS in the US. We'll be sure to report back when we have our interview in a couple of weeks.

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

Nik&Heather is right, the changes did become effective on May 1, 2008 HOWEVER the TB requirements DO NOT affect K1 applicants as K1 applicants are not required to undergo a medical (as long as the medical was completed less than a year ago) and the TB component is part of the medical (some doctors do try and tell you it's needed but that's usually because they either want the money, or don't know what they're doing).

All that said though, there is nothing that specifically says "no TB test for K1's" just the I-693 instructions (here: http://www.uscis.gov/files/form/i-693instr.pdf ) on page 4, FAQ 2. which basically states that K1's with medicals completed less than a year ago don't need another medical but they DO need to complete part 1, part 2 (vaccination section only) and part 5.

If you want to read the civil surgeons TB instructions here they are: http://www.cdc.gov/immigrantrefugeehealth/...structions.html but they don't really tell you much except what happens if you need a medical, and what happens if you get a positive result etc.

If you have your interview then you don't need to worry because you would have been sent and RFE or your interview notice would have specifically mentioned if you needed to bring anything. Even if it turns out she DOES need it done (which I doubt but just in case) then it's not a huge deal. Best of luck :)
