Hi, thank you, for all of you who helped me to understanding my daughter’s faith of I-130 denial? I have read and studied and took notes till my eyes hurt, that is all I have done since her denial. I will not give up until it becomes a reality. I am not a quitter and I will not give up on my daughter. I guess I will have to do what ever it takes for us to be a happy family together. I did read till I understand everything that was given to me from all of you on this forum. Thank you for your help. I will call Marc Ellis and let him confirm what all of you told me and go from there. I will also yet all of you good people know what he told me. You were also right I was hoping someone could tell me exactly what I wanted to here that did not happen. So again my family and I thank you from the bottom of our hearts. I hope all of the couples who are thinking of getting married and especially the ones with children beyond the age of 18 will read this forum and read all my plea for help and not have to deal with the tragedy and pain of having a daughter denied on an I-130 to come to the States with her mothers. I realize where I messed up and there is no sense in crying over spilt milk. What is done is done and we will just have to make the best out of our situation. We are survives of this life. Thank you. In the meantime, you can encourage your daughter to begin studying in earnest for the TOEFL test. She'll need a good score on that to get accepted to a US college. It's not as hard as it seems, since many community colleges have good programs for foreign students.

Facts are cheap...knowing how to use them is precious...

Hello Mr Gary,

I am sad upon reading your post because basically we have the same situation with you daughter, we have the same b-day & age & destiny. Here is my story. I entered US last 4/2009 as K4 together with my mom as K3.

I got EAD & SS# & a JOB also I got my drivers lic then.

July/2009 My USC stepdad applied AOS for both us along with my i-130, she got her approval BUT MINE WAS DENIED!(USCIS Reason?that i am not considered anymore as stepchild of my USC stepdad because i was over 18 yo then at the time of thier marriage. All of us was EMOTIONALLY DEVASTATED specially my mom was crying everyday that she dont want me to go back to the Phils.

There are 2 options that they advised us, 1st is to go back to Phils.,Let my mom petition me as an LPR to f2A. 2nd is to get married but thats not the option that i like bcoz i am not yet ready for that matter, & I dont want to overstay. so i end up going back to Manila.PH

Sept 28/2010 my mom filed i-130 for me

Oct 1,2010 i depart USA to Manila.

June 24/2011 I got NOA1

Mar 2011 I got approved

Jan 3 /2012 I got email from NVC stating that they are now processing my PD. I WAS SO EXCITED & HAPPY!

lATELY MY MOM CALLED NVC WHY WE HAVENT RECIEVE YET THE PACKET FORMS ETC to be filed. THEY SAID THAT MY F2A IS NOW F2B & no way for CSPA bcos they already reviewed.. VERY DISSAPPOINTED HERE & VERY DEPPRESSED. AFTER ALL THE WAITING & EFFORTS WE DID, NOW MY HOPE & DREAMS ARE ALL GONE. i MISS TO BE WITH MY MOM & MY MANY FRIENDS THERE IN THE USA.

As for now i am still pursuing my college course, hopefully i will finish schooling summer of 2013. I will try any option after i graduate from college. An F1 visa (for OPT). GOD WILL MAKE A WAY NO MATTER WHAT.
