Kind of complex but not unheard of... "Usually, persons granted B-2 visitors visas are admitted to the US for six months at a time, regardless of how long their visas may be valid for (as determined by the visa expiration date). However the date on the I-94 card, which a person receives upon admission to the US, controls. It is very important to leave the country before the I-94 card expires. If one is interested in extending his/her stay beyond the authorized period of stay as governed by the I-94 card, this should be requested before the I-94 card expires. Extensions may be requested in 6-month increments, generally up to a year."

Anyways, if she is no longer in high school, why the bother with the sheriff?

She doesn't ever get an I-94, she doesn't even know what it looks like. Her visa card just says an expiration date of the card itself-not the current visit to the US. And once again, whenever she leaves the US, nobody checks her to see if she left in a certain amount of time.

The time of each visit on a B2 can widely vary.

I'm aware that to go to school you need a different visa but isn't that for college n such or high school too?

Illegal presence before the age of 18 doesn't count. I don't remember if illegal presence is cumulative or not. It is also possible that if she overstayed buy 6+ months, went back to Mexico and returned to the US she may still be subject to the ban, even though they let her in. The technicality of the law is that her visa becomes invalid after the overstay. If you are serious about this woman, do not let her go back to Mexico until you have consulted with one of the qualified lawyers. Consult with either or both of the lawyers I linked to in my earlier post. This is another good forum to consult, in fact, it is the best waiver forum there is. My advice... if she hasnt left recently; therefore no intention of entering the USA fradulantely (not allowed to enter with intention on immigrating while on a B2, F1 etc)... So as long as she has been her for awhile... u can file AOS

Look, to stop worrying about overstaying and such, just marry the girl as soon as possible and file for AOS. IF she overstayed, it's going to be forgiven. Of course she is lying at the border because she is living here and going high school in the United State and is not a LPR. But your best chance to solve this situation is to marry and adjust asap without her returning to Mexico until she receives her green card.

It doesn't matter. She has left a trail. She was enrolled in school. etc etc. Don't be too sure that they don't know anything about her time spent in the US. You need to talk to a lawyer, and don't let her leave until you do so.

We live in AZ... here, at least, there's no questioning of legal status when registering for public schools-it's actually illegal to ask(in AZ) but Sheriff Joe Arpaio n his gang want to change that.

Sooooo...?

The sheriff is paid to enforce the laws of our country & Maricopa county. That's why we have police. Arpaio nor any other police agency writes the laws; they enforce them.

Your G F is in the USA illegaly using a tourist visa to live in the USA. She has done this for years & has lived as an illegal for those years. The tax payers have paid the price for her to be educated here.

Now you want help to avoid the laws again & people here are giving it to you. She needs to respect the laws & so do you.

In order to do that she should return to Mexico & stop abusing her visa. The visa you admit gives her legal entry for a few days at a time. Not the years she has been here.

Have her return to Mexico & then help her get a legal visa by following the laws just as well all did to bring our families here. You can petition for a K 1 or marry her & petition for a C R 1. She will be lucky if she doesnt have to answer questions about her abuse of the tourist visa. You will have to use some of the clever advise given here to avoid visa fraud.

Actually what he's planning on doing is perfectly legal. What she's been doing is abuse of her visa, BUT it's forgiven when she's the spouse of a USC. There will be no lying needed.

You are entitled to your opinion, but as what the OP is doing is considered legal in terms of immigration he is fine and doesn't need you to imply that he's breaking the law. You don't have to like it, but he's well within his rights.
