I-130 will assume processing at the same time as I-129F so that they are approved at the same time in 99.9% of all cases...

Then it will be sent to NVC, where they will send the I-129F back to the Service Center to be administratively closed. As of Feb. 1st, I-129F in pursuance of a K-3 will no longer be processed when petitions are received at the same time, which they almost always are.

Don't bother with the I-129F, just go forward w/CR-1/IR-1.

As you said it usually gets approved on the same date. If it does and reaches NVC together, NVC will assume the K-3 to be closed and will process with the CR-1.

I had read somewhere that I-130 assumes K3 NOA1 date? assumes? assumes what? sorry - no idea for assumption Is this true? it has been 3 weeks since my wife's NOA1. Is it worth it to apply I-129F? no - it is not worth it As far as I can see both I-130 and I-129F gets approved at same time; yes, that is correct

Does K3 slow I-130 processing?

ABSOLUTELY !

Once a K-3 is submitted, the 'time duration' for I-130 approval is tossed aside, a 'new duration' is started, the I-130 and I-129F are 'put together'.

Approval on the same day, but any speed you might have had - you lose - as the I-130 is taken out of it's prior queue, and placed in new queue with the I-129F.

Now - you can expect 1 thing, for certain, if you file I-129F for a K-3 -

When the K-3 arrives at NVC - it will be TOSSED AWAY, administratively CLOSED, because the approved I-130 has travelled with it.

Now - you can expect 1 thing, for certain, if you file I-129F for a K-3 -

Am I obtuse or missing something? A simple solution seems to be a separate I-129F process for K3 (just like K1) that does not require I-130... This gives the opportunity for petitioners to make their decision at the beginning itself

If you're trying to get your spouse into the U.S., you cannot submit an I-129F without the receipt number from the I-130 - the I-130 has to be submitted first. If you submit an I-129F, the processing of your I-130 will be pushed back to match that of the I-129F. They will be approved together and sent to NVC. NVC will send the I-129F back to the service center to be closed.

It's a waste of time and money.

If it's truly the case, then you or USCIS has made a mistake that is likely to cause either a delay or additional complications. You were to mail your I-129F to the service center where your I-130 is pending with a copy of the receipt notice for the I-130. If you mailed a naked I-129F to Vermont, they probably thought it was for a fiancee.

Facts are cheap...knowing how to use them is precious...

I would call VSC and try to have the I-129F canceled before it goes any further - but honestly, I would fall back on any advice Push gives you at this point.

I had read somewhere that I-130 assumes K3 NOA1 date? Is this true? it has been 3 weeks since my wife's NOA1. Is it worth it to apply I-129F? As far as I can see both I-130 and I-129F gets approved at same time;

In my case K3 sure did not slow anything but every case could be diffferent. Further after Feb 1st memo it looks like they will close down K3 if both I-130 and I-129F gets approved and reach NVC at the same stage. So probably it is not worth pursuing K3 at this point as allmost all of the cases I have seen during the last couple of months had them approved at the same time.

However one should notice that K3 is not completely dead atleast technically since USCIS is still accepting I-129F's. The real death of K3 will occur only when USCIS stops accepting those petitions.

9/1/2009: Applied for I-130

9/14/2009: NOA1 for I-130

9/21/2009: NOA1 for I-129F (CSC)

9/25/2009: NOA1 received for I-129F (receipt of mail)

01/08/2010 : Thank you very much Jesus..... NOA 2 129F

01/08/2010 : NOA 2 I-130

01/15/2010 : Embassy gets the approval notice (Awesome..Love K3...so glad we have done K3)

01/20/2010: Embassy schedules interview for K3

02/19/2010: K3 interview over and approved.

Uh-oh! I went the I-129F with a copy of the NOA1 for the I-130. I may have sent it to Vermont because I did not realize until recently that my case for the I-130 was at the CSC. Did I mess up?

Do nothing at all about the I-129F as it will be dead on arrival at NVC anyway. Just follow the CR1 guide and concentrate on the I-130.
