Affidavit of Support I-134

Hi to All:

I am on K1 and we are preparing our I-134 Affidavit of Support. My US Citizen fiance get two (2) kids from his previous relationship. On his Form 1040 he claims only one of the kid and the ex-girlfriend claim the other. Upon checking my fiance's I-134 I saw that he put on item 8, that his dependent is only the kid he is claiming on Form 1040. On his monthly paystubs wherein the child support he give his kids shows, it indicates that the two of them he is supporting. We are confuse which name(s) to put on the affidavit of support, 1 or two kids?

Another thing, if my fiance get $500 on his savings account is it okay to declare it on item no. 7 and get statement from his bank about this. His derive annual income is okay though. He also get stocks and life insurance but he never declare them on I-134.

Please help me.

I'm not an expert on this, but I think the most important thing to show on that I134 form is that after all his deductions and such for child support, that he can still show that he has income above the 125% poverty mark.

Yes, you can show bank statements to support you having money in the bank. That's considered liquid assets, or money that can be used immediately if needed.

Your fiance needs to declare everyone in his household, and any child support payments he makes as well. Bank accounts and other assets must be able to be turned into cash within one year, and that actual cash value is dispersed over the term of the affidavit. So if $5000 is available as liquid assets, not the entire $5000 offsets the annual income requirement.

My fiance declared that he gets $48,000 annual income, would that be enough to support him, the 2 kids and me? The kids doesnt really live in his house, they just stay at his house every weekends.

You should find something else to worry about. If your fiancé made $48,000 last year, you won't have any problems with his I-134 during your interview...even if he claims both kids.
