AOS application outside of processing times

I applied for my AOS, based on a K-1 visa, at the beginning of July last year. Had problems with my EAD because even though it was approved in just a bit over a month, my biometrics appointment was never scheduled; when I took an infopass appointment for interim EAD, the IO lady noticed what the issue was and got my biometrics scheduled. This was in the second half of October and biometrics appointment was in the beginning of November.

Then, before the end of November I got an interview notice (scheduled for the end of December). After a few days I also got an interview cancellation notice. Since then, nothing :( My LUD in my account on the uscis site is December 1st. In January I called customer service which filed for case service because I was out of processing times, and after a couple week I got a notice from the local field office saying that they're actively processing my case (but then again the soft LUD never changed in the past three months...)

I went to two infopass appointments but the officers never told me what was going on. I scheduled another one 10 days from now, hope I'll be able to actually go cause my work schedule is very variable right now... but then again I don't know if they will tell me anything useful at all >_<

I'm just not sure of what else I could do to figure out what's going on. The only idea I've been able to come up with is that maybe because my biometrics were taken so horribly late, the FBI check might be running late too? Which would be fine, I don't mind waiting more but I'd just like to know the reason :(

I'm just getting kind of depressed because at my workplace I keep meeting people who got their green card in 4 months or so, and I don't even know what's going on with my case :unsure:

My husband's biometrics was taken 6 months after his visa expired.... we had no issues... I doubt that it's about a late biometrics... Don't worry that your green card is taking longer than 4 months. Some people get lucky, but the normal time for processing is 6 months I think. Check the USCIS website to see what the processing times are, and if it's taking longer than the estimated processing time, I'd contact USCIS directly. Best of luck

It is definitely taking longer of estimated processing times for my field office, cause last time I checked the site said that in November 2009 they were processing cases sent in August. Mine was sent in July, so yeah D:

I already called USCIS customer service and also took infopass appointments and all they tell me is that "they're still reviewing it".

Moreover, in my first post I forgot to write that my case status on USCIS site is still listed as "Acceptance" phase and was never updated since last July :/

You just got lucky because I read this post. I had really long delay with my J1 waiver approval everyone used to get it 1 week after the State Department approval except me... I had to call every day for a month and fight with them to find out my options until one day I kept asking for supervisors and after talikng to 4 opersons I actually got an answer. Sorry for the long story..

First call the customer service and talk to them again talk to a second tier person( ask to be transferred to an Io since the first person just read whatever we can read online ) and tell them that you need some type of resolution and if I guess right they will have no answer for you...then ask for her/his name and write it down since you will need it....also ask where is your application at which service center since you need that info too.

Than you have to write your story to the following e-mail addresses ( you have to include the name of the officer you talked to before and tell them about your previous attemptes to get an aswer ):

California Service Center: csc-ncsc-followup@dhs.gov

Vermont Service Center: vsc.ncscfollowup@dhs.gov

Nebraska Service Center: ncscfollowup.nsc@dhs.gov

Texas Service Center: tsc.ncscfollowup@dhs.gov

(that is why you need to know where is your application)

After a few days I got an aswer from them and my application for waiver was approved after one week.

I'll wait one more week (since I have an infopass scheduled on the 9th) and if the IO there don't tell me anything about my case I'll definitely do as you explained. I would at least like to know what they've been doing with my application since it appears it hasn't been touched for over 3 months now >_<
