How to get an interim EAD

Timeline

We filed for AOS 86 days ago, we had our interview today. The agent stated that my husbands EAD had been approved February 2nd, and she did not know why we hadn't received it. So we called the 1-800 number afterwards and they stated she was correct, but could not tell us where his EAD is? The problem is they told us to go to the district USCIS office and talk to them. However, he cannot go to the district office without a valid ID (his expired today) and he cannot get a valid ID without an EAD...so we are in this eternal loop of needing an EAD but not getting one. Anyone else been approved and don't know where the EAD is? We never even received an approval notice in the mail, and he scheduled an INFOPASS appointment for Thursday since he will officially be past the 90 days, but they said they won't let him in the building, even if he has an appointment because his ID is expired....anyone else been in this situation?

What ID has expired?

As far as I know a passport is fine. Also bring your NOAs and other USCIS letters you've received.

02.03.2010 - Case Transfered to CSC

02.16.2010 - I-765 approved. card production ordered

02.24.2010 - Employment Authorization Card arrived today!

03.05.2010 - I-485 APPROVED, "Notice mailed welcoming the new permanent resident"

03.11.2010 - "Welcome to the US of A" letter arrived

03.12.2010 - PR Card arrived

Dec. 5, 2011 (Monday) - Is the date when I can apply for Removal of Conditions

What ID has expired?

As far as I know a passport is fine. Also bring your NOAs and other USCIS letters you've received.

His CA drivers license expired 2/10/2010 and his passport expired 2/25/2010 so he has no valid ID at this point.

He can still go to an infopass appointment with his (now expired) ID as far as I know - I don't know who 'they' are that told you that (I've heard of enough folks who had to do the same, it is certainly one reason why a person might have to actually go to USCIS in the first place).

Well the "they" is the security guards that guard the front of the building we need to get into. He is planning on going on Thursday and just going to explain everything and hope the security guards let him in! It really makes no sense, because you are correct many people who go there I would think have no "valid" ID since most states won't issue even state ID cards without proof of legal residence. But yesterday when we went for our interview, they would not let him in, because his ID was "expired" that day. He had to wait outside while I went upstairs and talked to the immigration agent and she had to then have the security guards escort him upstairs...it was weird.

If his passport expires 2/25 then technically he's good up until midnight of that day. So they shouldn't have been an issue that his passport expired when you went yesterday. If worst comes to worst, I would imagine that he would be able to renew his passport at his country's embassy. I'm currently helping a friend of mine extend his passport. The Lao embassy has a website to download the form for an extention. It's their job to assist their citizen since your husband would still be consider a citizen of Guinea. It's probably a good idea for him to get his passport current anyway for other reasons.

09-30-09 Interview - Passed but they wanted copy of my passport of the 2nd visit

10-08-09 Visa issued

10-18-09 POE - Newark, NJ

10-26-09 Applied for marriage license

10-31-09 Recd license

11-13-09 Wedding

11-16-09 Applied for SSN

11-21-09 Recd SSN

12-05-09 Sent AOS
