Timeline

hey everyone,

am in the process of filing taxes am needing some info.

I am using turbotax and wanted to e-file, but guess is out of question.

My spouse has no ssn/itin. I am sending in with fed return the W-7 for ITIN.

P.S EAD is being processed as I speak, according to uscis, but don't know when

we'll get.

That should suffix for not having ssn/itin, right??

Also, how do I go about filing state that requires the same??

Will appreciate any help given.

Since she is with you, just send a copy of the I-94 showing her status or proof of her status (the acceptance letter for AOS) the w-7 lists all the info that you would need to send with the form. I know back in the day you could just go to the social security office to apply for the ITIN....of course they have to complicate the process even more. I am trying to get an ITIN for my wife, but I think it is a losing battle right now...probably just file for an extension on my taxes until she is with me.

As far as state...I think you have to wait until you get the ITIN for your wife.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

suggest you go paper, on both federal and state, this year, as even if she had SSN now, is no record of prior use of it - and will fail the turbotax checks (which mimic the IRS checks)

You can wait a bit longer for the SSN, that would be my advice.

OR do the ITIN - file all paper return, to the special W-7 address in Austin TX.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
