Ok, so now I am a little bit confused about the medical exam. Do i submit that with the I-485 when i file for it or after?

Just to make things clearer.

For Petition using I-130, use the following:

I-130

G325

All sorts of proof (in my case marriage - pics, bills, lease, etc)

I-864 for all parties included in sponsorship

Check for $355

When filing for AOS using file I-485, use the following:

I-485

Check for $1010

I-765 (employment authorization)

I-131 (petition to travel before approved)

G-1145 (E-notice)

Is this it or are there other items? :whistle:

Please excuse the questions. I would just like to do this right the first time.

Also, I noted that there are different locations for filing the I-130 and the I-485. I assumed as one package that they went to the same location. Guess I was wrong. :blink:

Timeline

F-1 expires 60 days after studies are over, or 90 days if you have applied for an OPT, but haven't got a job. It might say that there are 2 years left on the visa, but this is not valid anymore after you graduate. However since you have got married your overstay will be forgiven.

Just to let you know:

Sorry to nitpick again, but technically the I-131 goes with the I-485 as well, since you are the petitioner on both (as opposed to your USC spouse, which is the petitioner on the I-130). In the end, however, all of the above will be mailed in the same envelope... ;)

Finally: Yes, definitely get the medical done and sent it in with the initial application package, to avoid a RFE and delays down the road.

AOS:

12/05/09: Sent AOS package to Chicago lockbox.

12/11/09: USPS reports delivery of package.

12/16/09: I-485 check cashed.

12/17/09: I-130 check cashed.

12/19/09: Received four NOAs in the mail (dated 12/15)

12/28/09: Received biometrics apt. letter for 1/8/10

01/04/10: Walk-in biometrics done (Santa Ana, CA)

01/26/10: Received interview letter for March 10

02/05/10: EAD card production ordered & AP approval notice sent, both arrived in the mail shortly thereafter

How does this all work for someone that marries when they are here on a visitors visa? Can they do a change of status and not have it rejected? Is it questioned or looked at the wrong way when this is done?

After reading this,

BE WARNED:

You must qualify to file for an I-130 in the US. Not everyone does, and in some cases doing so can be considered fraud and result in being deported and banned from re-entry into the US for a period of time. If you attempt to file and you do not qualify your legal status in the US can be placed in jeopardy. J1 Visa holders will almost always require a waiver and should consult with an immigration lawyer or the USCIS for more information. If you have any doubt, consult an immigration attorney.

If your fiance/fiancee came to the US on a tourist visa with the intent of immigration and marriage, and you are not yet married, then he/she should return to his/her home abroad, and the K-1 visa should be filed (using an I-129f) instead of the I-130 to avoid a denial, deportation, or even being banned from re-entry to the US.

If you are already married, and your spouse came to the US on a tourist visa with the intent of immigration and marriage, then he/she should return to his/her home abroad, and the I-130 (or along with an I-129f for a K-3 Visa) should be filed with the relative outside of the U.S. to avoid denial, deportation, or even being banned from re-entry to the US.

The above conditions are serious and can result in the separation of families for many years if not taken seriously.

I just would like to know what can be done.

SO i just received my NOA in the mail and I am awaiting my Biometrics appointment letter in the mail. I have a USCIS center which is 3 hours away in a different state while the one for my state is 8 hours away. How do I know which office i will have to go to for my interview and my biometrics appointment?

I have looked on here but I haven't found anything that hints to finding out which office will handle your case or whether it can be changed or not. It is just a thought. Any advice would be appreciated.

Hey Corbin

It is perfectly ok if a person enters the US on a visitor's visa and gets married to a US citizen. The person can apply for adjustment of status and get the greencard between 3 to 5 months.

The warning applies to people who obtained a tourist visa to get married or were married beforehand and then got the tourist visa. These people must return to their country and file for the greencard through the consulate.
