Hello guys,

My situation is this. My brother passed in May of last year. And he had a 3 year old daugther. His wife don't want to take care of thier daugther anymore and my wife and i want to adopted her and bring her over here in the state. Do anybody advise me how to proceed and which forms do I need to file. By the way I'm a naturalize US citizen.

You will have to find out what you need to do to adopt your niece first before you can file any paperwork since you can only file for immediate relatives at this point.

this is way more complicated that you think. people try to use adoption of neices and nephs and younger brothers and sisters to circumvent immigration law all the time. the USCIS is not friendly toward this scenario. basically, you have to live in the foreign country as adoptive parents for 2 years in order to get immigration benefits for the child. the fact that the mother is alive makes it even more problematic.

the law allows adopted children to immigrate with the intention of allowing existing familial relationships to continue, not for new ones to be generated, regardless of the reason for the genesis.
