Incorrect Entry Date on I-94

Well things were going along great and Oksana and I were married on Jan 29. So while we are waiting to receive our certified copy of our Marriage Certificate, we started getting all of our papers together for AOS. So I am examining the I-94 for Oksana and my step daughter and notice that their entry date is Nov 20, 2010.

So I filed the I-102 for both I-94s 2 weeks ago and today I called the Misinformation Line at USCIS to find out the status of this. Well I was told to wait 30 days but as we are in a time crunch because my step daughter is 20 years old to go ahead and file the AOS without the I-94 and expect an RFE for these documents.

My question is (if I was told correctly) how will this affect the EAD and the AP? My step daughter wants to return to Ukraine this summer to see her Grandmother.

you can go to a CBP secondary inspection office and have new I-94s issued.

It won;t affect anything. Stop calling the uselss phone line. You are fine. "Call back in 30 days" is number 14 on the menu. It means nothing.

Dave

File the AOS, EAD and AP papers with copies of the I-94s you have. You should have the APs in less than 60 days. You are fine. Clerical errors do not cause a problem.

Yes you would.

They will re-issue new I-94's with a proper date. They will likely scribe an explanation on the re-issued I94's as to why they have issued new documents.

This is what I would do if it's feasable and doesn't stretch out your time frame.

Our journey together on this earth has come to an end.

Just to say the date on my I-94 was stamped wrong too. When I sent the stuff in for AP/EAD/AOS I just pointed this out on the photocopy of my I-94 and also included a photocopy of my boarding pass showing the correct date of entry. No issues at all getting my documents, and it's happened to other people on VJ too. These mistakes happen pretty often it seems!
