Hi, I just want to ask a question regarding travelling outside the US while the Petition to Remove Conditions on Residence still on the process.

I already send my I-751 application last January 04, then receive the NOA and they already cash the check and Last February 16, I do my biometric at ASC.

Me and my husband are planning for a vacvation outside the US this coming March but it makes me worry that I could meet some problem in coming back because my 2 years green card will expire on March 8 2010. Though it was indicated in my NOA that they extended my condition status for one year and I could travel abroad and work. What I should do, so that I could travel outside US and coming back without problem in immigration? Please help me.....i really need an answer for this.

Yes you can travel with the extension notice , BUT , before you travel check with your airline if they need something called a "FLIGHT PASS" on your return trip to the United States. Many times airlines need this extra piece of documentation , this document can be obtained from the IS embassy of the country you are visiting

The reason airlines ask for this document is because they do not want a situation where they have to fly back a passenger if he or she is denied entry at the POE , I am very well aware of a situation like this because it has happened with one of my close friends who was visiting the Phillipines last year and was not allowed to board the plane from Manila , they had to cancel the trip , get the flight pass from the US consulate and then fly back

I am not saying that this will happen in your case , but it is better to be informed

If you bring with you:

  • Passport (of course)
  • NOA1/Extension Letter (copy should be fine)
  • Current or now-expired PR/Green Card

You should be fine reentering the US. (Some might suggest a copy of marriage certificate but I think that isn't really necessary.)
