Petitioner Background Investigation?

as i said in recent posts we got NOA1 in May, 2009! Our atty contacted uscis about delay and I received a paper letter on Dec. 9, stating; "required investigation into your (my?) background remains open, if no word by 180 days (half a YEAR!) contact us at 1-800-***". What could possibly take this long? I've always been self-employed so no employers to contact, (house painter), i have no criminal convictions, and last speeding ticket was in like '98. None of my prior 2 (K-1) wives ever filed charges or nothing against me for any reason. The first is easily findable by phone but the latest has disappeared with her affair boyfriend, not even her family back home knows how to contact her. I was talking to a new sheriff's deputy in the gym the other day who said his background check to be a cop took 4 months!

Then to make matters worse, i was in walmart last week and saw a young Phillipina lady with an older white guy and told them how seeing them together made me miss my fiance even more. He replied that CVC lost their papers and it took them an extra YEAR to get her K-1! That really made my day and i continued shopping, alone, with tear filled eyes. Its just not fair! I've heard of so many people doing sham marriages for money who got it done, yet here we are, in a true love engagement, who are endlessly delayed!

Sorry, but i just needed to vent!

It could be anything but most common is when you have similar name problems and they have to physically check each name against yours.

Timeline

I wonder if your delay has anything to do with you having had filed 2 prior K-1's. Typically if a name check at the USCIS level has a hit, they can clear the name within 60-90 days. As you state that you have no criminal convictions I'd be more inclined to believe the delay is due to your prior K-1 visas.

I'd contact your congressman and have him/her file an inquiry. You're petition has been in initial review status for way too long.

Yes, I agree, the two prior K-1 visas could be a problem. It is a little strange the way you wrote neither filed charges (I am paraphrasing).

The other thing is if the have places to contact or check out then it is easier for them to check off items on their list like previous employers. Since you are self-employed maybe they need to look elsewhere to find the references they need to cover that.

But the two K-1 wives might be a flag.

I'm gonna give a benefit of the doubt here and just opt to think that the comment by OP simply meant - he has no criminal record, as in - nothing bad happened.

But just the wording of that sentence is so not right...

I am just speculating...... but the statement given by the OP [neither filed charges } does raise questions...

maybe I wrote that kinda weird looking. my first K-1 and i divorced on a friendly basis, after 11 years. i never did nothing to hurt her, nor she me. my 2nd was the same except that she met a guy in secret in a club, began an affair, then vanished, after 7. i never mentally or physically abused either of them. lets keep this site civil, unlike some of the other flaming sites out there. don't be jerks! i'm innocent here and its not my fault the first two didnt last forever, and that i've fallen for another one!

If this is the case I suggest you contact your Congressman PRONTO.!! because you have waited way too long......

BTW... This forum [Dec K-1 VSC] are full of educated people who joke around alot. But when a serious answer is needed we are not Jerkoffs.

I know that it's tough. We had to be patient and it felt like forever! I am feeling for you! We had to wait through typhoons, holidays, and lost paper work. All I can say is that it's the government and don' t expect anything fast.

I think you are correct about 2 k-1's! Have you considered using a paralegal to get your through some of the snares? Sometimes they can expedite things.

Given the lengths of the prior marriages I don't think their suspicious of a "fraud" marriage thing.

I'm sorry it's taken so long, it's rare but sometimes they do "misplace" files so a call to your congressman sounds the best bet. **fingers crossed** for you!

thats a little better guys. i hired an atty from the get-go cuz i figured this 3rd time would be difficult, allan lolly and assocs, fiancevisas.com, so far they seem fine. the nice paralegal whos handling our case said, do not contact my congressman, cux that'd make it ness for a supervisor to look at file and then itd get put in bottom of pile and delay things even more?? but im sorely tempted, esp since montana has pretty easy access to them and not a lot of k-1 one issues, i.e. few immigrants here. yeah, you'd think they could see that 11 years and 7 years, do not a fraud marriage indicate. neither were, nor were they mail order intro's either. after so many times to their country (15 since 1988, and 3 in the last 14 months!) i know tons of people there.

ok, i'm gonna bite the bullet and this morning go to both Senators and our one Congressmans office with a letter asking for their help! hope this helps get something done for our case!
