How to get access to my original POE package?

Hi there,

I got RFE for form I-693. We submitted the DS-2053 ( our overseas medical examination ) with our original application and it was in the package that we hand carried at the POE. Inorder for the local surgeon to fill out the form I-1693, he needs information from the form DS-2053.

It is our understanding that the POE package is forwarded to our local service center? How do I get a copy of the form DS-2053? Someone told us that we may need to file form I-G693, freedom of information act. Any idea how long this might take as we have limited time to respond to the RFE. Our other option is to do an entirely new medical exam which we really don't want to do.

Thank you

It would be probably easier to contact the original doctor who did the exam, or get a new one, then trying for a FOIA request.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

You do NOT need the DS-2053 medical report to take to the civil surgeon... you do not need a new medical exam (I-693) if it less than 1 year but since they appear to have lost it then they cannot provide it. If they had it they would not have given you and RFE... the CS will simply do need to do a new exam

Thanks for the reply guys. The original doctor... they may have copies there. we will try that too. We have nobody there to contact him directly but we will try to call him.

The DS-2053 we submitted wasn't completed as the Vaccinations part wasn't done. So we need to do the I-693 now and the local surgeon needs the information from the DS-2053 to do so. So going with the FOIA is our best chance?

Thank you

Try involving your local congressman to raise an inquiry with USCIS - that may make them look harder for your missing record. FOIA is going to take a long time (I think I saw someone on here request it and waited a year for response).

In the meantime, try to get another copy of the medical and get the vaccination sheet transcribed. You could also go to the CS with your personal records of vaccinations (yellow booklet from WHO or personal medical booklet that has vaccinations in there).

It seems many (including ours) received this RFE, we went to a CS, had them transcribe the vaccinations, fill out the I-693 sections related to the vaccinations, and sent the sealed packet back with the RFE. (we paid $25 for this service), but several other CS I contacted required a office/doctor visit & charge before they would consider this.

The update on the web site for us was "they received our response to the RFE, and have started processing again." I do not know if that means we satisfied the requirement, or another RFE will come soon. I hope the later one is the case.

It does seem that they are sending this RFE out to many, and as I have read about others that have received & done as we have, it seems to have been successful, but your mileage may very.

A copy of the DS-3025 should have been included along with the I-693 form. If you didn't make a copy of it or ask for a copy when you took your medical abroad, you may need to repeat everything since who knows if you've received all the vaccinations. The CS will not take your work for it and they and you have no access to these documents now in USCIS possession.

There are a couple of different flavors of the medical RFE, so it's kinda hard to say for sure what they are asking for unless you type out the whole text.

It is incorrect to say that they don't have it if they are asking you for it. More and more people are going through their congressperson/senators, and the ones who actually take the time to go through them have been finding that with a little more firepower, the medicals are suddenly found! I haven't heard of anyone being successful with an INFOPASS or a call to any 1800 number. There are reasons for this that I really don't have time to go into right now (at work), but there are bugs in the system, and that's the way we short circuited them, and others as well.

There are some things that you do need to make sure that you have done/submit.

1. All vaccines must be completed. If they were not completed for the overseas medical, you will need to have them completed.

2. Have your vaccines transcribed to the I-693. As mentioned, this should be for a nominal fee $0-$50. Even people with complete vaccines have been RFE'd specifically for parts 1, 2, 5 - so the old trick of just sending in DS3025 doesn't work any more.

3. Send in a copy of DS3025.

We had the exact same issue and after wasting a lot of time trying to get another one from the original doctor, Lars finally went and had everything done again, here with a local civil surgeon. Yeah, it costs us about $150 (AGAIN) but I wish we hadn't wasted so much time trying the other.

It seems like we will have to do the full medical again. Do you guys know what the medical here consist of excluding the vaccinations? standard blood tests and what else? So we have to get naked again? How expensive is it? Anyone in WA know any good CS that doesn't rip you off?

Thank you

Aside from the vaccinations, the CS asked my wife her history of drug use. But providing your vaccination record takes care of most of it.

standard blood tests and what else?

They did a blood draw, and tested it for syphilis. Results took about 48 hours.

So we have to get naked again?

Um, no. My wife was not required to take off ANY clothing. So, she was very happy with that!

How expensive is it? Anyone in WA know any good CS that doesn't rip you off?

My wife's medical exam was ~$140, but insurance covered most of it. Her deductible was $30.
