Hello,

I have a question about the form I-864.

I got married to a US citizen here in the USA and I am filing my application for green card. My husband is working and is doing construction but he always gets paid cash and he never file his money as an income and never filed taxes either. So I am very confused on what to do about the form I-864. On the other hand his mom has her own business and earns good money and willing to file the supporting papers for me, My question is that -- Does she need to fill up the form I-864 and file her taxes too?

And does my husband need to fill up that form too or just his mom?

I would appreciate some answers.

THE US citizen spouse MUST submit an I-864 as the primary sponsor. And that person must submit their most recent year's tax return. (See page 8 of the I-864 instructions)

MIL can be a co-sponsor if needed. She would complete an I-864 or I-864A along with all the needed supporting documentation.

Right.

If your husband did not file taxes he will have to include an explanation of why not. That reason cannot be that he just didn't feel like it.
