I dont know if anyone else has experienced this, probably, thats why im on here asking for help or advice. My then-fiancee', now- wife has become so homesick that she wants to end our marriage and go home :crying: . She's from a warm climate, had never left home and is close to family. She got here right before one of the worst winters in memory and things have been stressful to say the least.... the stress has affected our marriage to the point that it may be beyond repair :( ...Guess blood is thicker than marriage..anyway, i just sent off the damn AOS package, along with $1012.00. my question; is there any way i can stop/halt the AOS process and get my money back? at least cutting my losses and getting my money back would ease the sting of this whole mess. if anyone knows anything, please reply. i know they have already received my package [ mail confirmation ] and if there is a way to stop it before they go too far i would like to. im still in shock that everything i have gone thru to get her here has been for nothing.........

well you could check to see if your check has been cashed if not put a stop payment on it that would prolly end the aos

I'm sorry to hear what you're going through.

I agree, if the checks have not been cashed, call your bank and put a stop payment on the checks.

Stop payment on the check.

If it has already been cashed you are out the money sorry to say.

Have you explained to your wife that probably within 60-90 days she will have her AP (hoping you filed for it) and she will be able to return home with the option to return and continue the process (with certain time restrictions)?

It is very stressful for someone to come to a foreign country and to be away from their family. Have you exhausted all means for her to keep in touch with them? we use magic jack and the rates are wonderful for him calling home. The computer and webcam thing works well also.

Try to emphasize the positive to her and keep reminding her visiting home is an option in the near future.

As to the snow (a four letter word) I am from Texas and live in Kentucky now and I can understand entirely how she feels. Cabin fever could be a cause of her homesickness also. She has not had the opportunity to get out and see what your area has to offer her.

Why not try saving the marriage instead. If youf mutual love was there then you two may be able to re-kindle it. Take a vacation together to the Carribean.

Ditto to all the posts above. However, coming from a tropical country myself and I've always been really close to my family as well, I think she should have some time to get used to the place. I mean, it's definitely tough coming to a new country with everything different. I had times when I cried in my husband's arms telling him how much I miss my friends and family and he just listens. It made me feel better. Maybe it's not that bad after all, just try to listen to her and do things together that will make her feel more like home. It could be something crazy like what my mother-in-law did for me, she bought me lots of cow themed stuff as she knows how much I love cows... stuff like that.

you can write a letter , withdrawing your I-864 Affadavit of Support, to:

1. the address that you used to send off the AOS packet and

2. the address of your local USCIS office and

3. the general DHS office for your area.

(I say AND here - make it 3 letters, 3 addresses)

Then, put her on a plane for home.

If she still wants to be with you, later, file a new I-130 .

You can divorce her, as well, easily - just go file now at the courthouse, inquire about 'waiver to appear documents' - have her sign one of those, as well, prior to jumping.

IMO, you won't get yer money BACK, but you can absolutely 'stop payment on the check', today.

How cold can it be in Southern Florida in the winter? If you don't live in Southern Florida, that's your problem right there. Heck, I wouldn't want to move anywhere where it's friggin' cold, and neither would my wife. Hence, that problem could be solved quite easily.

The homesickness is fairly normal for many people who are transplanted into a new environment. The goal is to make this new environment home. Works in most cases, just takes some time. I haven't visited my old "home" since 1994 yet I'm home ever day . . .

I have been here since April 2006 and got my greencard November 2009 and was fortunate to go back home for Christmas 2009.

Yes, I well understand her frustration, I was unable to work, got pregant & have a remarkable son, my mother unexpectedly died and I was unable to attend.

What helped us was and still is - a lot of prays.

Is it so bad that you guys are have already made up your minds to separate??????????

Thanks for all the advice, info and support. we are trying to work on things. unfortunately i dont live in Florida, where the winters are less harsh. we got snow in Texas 4 times this winter and we usually get none. it was cold even for me and im used to the cold...plus she cant work yet- i know its hard for her and im doing my best to keep her happy and occupied. she can call home whenever she wants- got a great phone plan - plus be online. we are trying.......thanks...and hopefully things will work out.

actually they returned my AOS package for incorrect fees..i didnt know the money orders/checks had to be separate for each part. FYI ...the fees have gone up;

Adjust Status=$930.00

fingerprint=$80.00

EAD= $340.00

I-131/travel=$305.00

Since we are trying to work on saving our marriage, I am going to resend the package. Does anyone know if the whole package has to be sent at the same time or can it be sent separately? example; sending the AOS and fingerprint now and then send the EAD and travel later or vise versa? just curious...

i was just reading the fine print on my rejection notice and it reads that i dont have to pay a fee for the EAD and travel document if im filing it at the same time i file the AOS. anyone have any experience with this? i dont want to make another filing mistake if i can help it. that would mean i only need to send in the $930 and $80 fees.

You are kidding, right?

Here's info taken from USCIS.gov web page for I-485: $1,010 ($930 plus a biometrics fee of $80). Exceptions apply. See "Special Instructions" for more.

You really need to read the guides so you know what you're paying. The fees have NOT gone up.

You send the entire package together in one envelope to Chicago Lockbox. Do NOT separate the forms, keep them divided but together.
