Will application for B-2 hurt my Fiance's chances?

Hi everyone, Great site.

I am a US citizen going to visit my Fiance in Dubai, an Iraninan national for the first time in a few days. We are planning to apply for a visitor Visa for her.

I am planning to file for K-1 when I return from Dubai.

If her B-2 application is denied which is very likely, May that hurt her case for K1 when it gets apporved??

You are right. The B-2 isn't likely to be approved. However if it is approved, it will not affect your chances later on in the K-1 visa petition or interview. If it is denied, I think it should not matter. She just needs to say she wanted to spend time with you in the USA but it was denied. No big deal.

It shouldn't hurt her case. My wife's student visa was denied (but that was 8 years before I applied for K-1 for her) and during the interview they didn't even ask us about it (or photos etc)

They did mention that since I was present during her interview, that in itself was a big factor for them to judge that the relationship was real.

K-1 Timeline:

Oct 06, 2008 - I-129F sent to USCIS

Jul 08, 2009 - Interview at Montreal Consulate

Jul 10, 2009 - US Entry. POE: Buffalo, NY

Jul 15, 2009 - Marriage

AOS Timeline:

July 29, 2009 - AOS, AP, and EAD sent to USCIS

July 30, 2009 - USCIS receives Documents.

Aug 05, 2009 - Received NOA Dated July 31.

Aug 10, 2009 - Biometrics letter. Appointment date: Sep 2nd.

Aug 13, 2009 - AOS transferred to CSC.

Sep 02, 2009 - Biometrics done at Elizabeth, NJ location.

Sep 16, 2009 - Received emails of EAD(Card production Ordered) and AP(Approval notice sent).

Sep 21, 2009 - Received 2nd email of EAD(Card production Ordered)

Sep 22, 2009 - Received AP.

Sep 26, 2009 - Received EAD Card

Oct 19, 2009 - AOS transferred back to NJ.

Nov 05, 2009 - RFE for I-693

Dec 02, 2009 - USCIS receives I-693 vaccination supplement.

Jan 06, 2010 - RFE for Entire I-693 needed since CBP/USCIS loses our documents.

Feb 04, 2010 - I-693 received by USCIS.

Feb 17, 2010 - Green Card in mail!!!

Conditions Timeline:

Nov 17, 2011 - Sent I-751 application to Vermont office.

Nov 22, 2011 - I-751 Receipt Notice/Extension letter sent by USCIS.

Jan 04, 2012 - Biometrics done at Elizabeth, NJ location.

Aug 31, 2012 - GC approved.

Sep 11, 2012 - GC mailed. USCIS says we should receive within 7 days

I'm going through a similar process right now. In our case, the K-1 has already been filed and we're in the "waiting for the NOA-2" phrase. We're going for a B-2 in the meantime.

Everyone I've spoken to with personal experience and/or authority with this has stated that a B-2 denial will have no affect on a K-1 as long as you are/were truthful during the B-2 process.

K-1 Timeline:

2010/02/08: I-129F package sent via USPS Express Mail

2010/02/12: Received at CSC by Linda Fairbanks

2010/02/16: NOA-1 issued

2010/02/17: Check cashed (no legible receipt number on back)

2010/02/22: NOA-1 hardcopy received

2010/04/02: Touched

2010/04/04: Touched again (Easter Sunday?!?)

2010/04/05: Email/text notification of NOA-2

2010/04/05: NOA-2 Notice Date on I-797

2010/04/12: I-129F received by NVC

2010/04/15: I-129F petition left NVC for Moscow

2010/04/16: I-129F petition enjoys a layover in Cincinnati, OH

2010/04/18: I-129F petition hangs out in Vitoria, Spain

2010/04/20: I-129F petition drinks a bit too much lager in Leipzig, Germany

2010/04/22: I-129F petition arrives in Moscow, looking like it was rode hard and put away wet

2010/04/25: Emailed the U.S. Embassy in Moscow asking for interview date

2010/04/28: Response from Moscow that our interview is 8 Jun 2010 at 10am

2010/06/08: Interview at the Moscow Embassy
