Ok here is my question, i work overseas in Kuwait, i want to change my K1 to get married here and do DCF, now from what i was told by the embassy is that once we are married the K1 will be no more, i understand all that but now i hacve to ask why is it that if you both have lived in the same contry for 4 years together and i have maintain a home in the states banks and pay my US taxes, i was told by the embassy here that if i want to bring her to the states i would have to show that i am moving back to the states meaning i would have to resign here and show that i have a job in the states or be truly seeking a job, now is it me or does that sould a little out of norm why would i quit a job here and be unemployed and show them that im looking for a job wouldnt that seem dumb to leave a 120k job to be unemployed? well that what they told me i would have to do for a K1 visa and if i wanted to file there DCF, i need a little advice from someone who has done DCF pleas leave all the smart comment off just want some sound advice please.

I would just show that you are seeking a job, not necessarily quit. Everything else you said should satisfy most embassies. I don't know about kuwait but they can't be lenient. London dcf is EASY. They didn't ask for anything to show that I was moving back.

Hi,

What they are talking about is re-establishing domicile. You have residency in Kuwait and you need to re-establish your domicile in the US. This is a very consulate-specific issue. Canada is notorious for driving people nuts with their IMHO ridiculous requirements of re-establishment of domicile. I am hoping that Mexico will not be quite so difficult, but then I haven't been here long enough for Mexico to be my tax home, so I'm not too worried.

I know there are others, just use the search function with "domicile" and you will come up with a lot of related info. One of the forms specifically talks about this, but I don't really remember which.

I understand that this is your decision, but you have already paid the first fee for the K-1 and I saw that your interview is scheduled for April 6. I have a hard time thinking DCF would be faster than a month in the time it would take you to get married and file papers, although I understand that you must have your personal reasons. I'm just going through the process of getting married in a foreign country and it is not so fun.

April 19, 2010 - NOA1 (documents received at Mexico City Embassy)

April 20, 2010 - NOA2 (received notice April 28, 2010, mailed April 27)

May 3, 2010 - Packet 3 sent (received May 27, 2010)

May 9, 2010 - I emailed them using the inquiry form asking for my case number

May 17, 2010 - received case number and link to Packet 3 by email

May 18, 2010 - sent Packet 3 to Ciudad Juarez

May 28, 2010 - called Ciudad Juarez to see if we had an appointment yet, they said wait 6-8 weeks :(

May 30, 2010 - I return to the US

June 8, 2010 - called and found out appointment date

June 16, 2010 - received Packet 4

July 6, 2010 - interview - Approved!

July 7, 2010 - pick up visa at DHL and POE to activate

July 29, 2010 - welcome letter received

August 1, 2010 - my husband comes home to me

August 13, 2010 - received Green Card

September 28, 2010 - never received Social Security Card, had to apply for it, arrived Sept. 28
