travel to mexico prior to marriage

My fiance has her K-1 visa issued in peru. She and I want to travel to mexico before getting married.

I read in the notes on this site that this has been done as long as the I-94 is not surrendered at the border and you dont fly there.

Has anyone had else tried this successfully?

Hi there!

Me and my american fiance were thinking about the same..to meet in Mexico since it is not recommended to meet in the US before K1 is granted..

I would like to know if anybody knows if there is a problem just making a connection in the US and continuing to Mexico..

You cannot enter the US then fly to Mexico. When an international flight arrives to the US all passengers must pass through CBP. At that point you would use your single entry for the K1. Now it might be an option to fly first to Mexico and then to the US afterwards. You'd both have to make sure you had all your documents required to enter Mexico as visitors and then make sure you also divulge that information on your papers when you enter the US.

Not sure how a "pit stop" in the middle works - never gave it a thought. We transferred in Tokyo from Ho Chi Minh City and entered POE Detroit. Never gave it a thought to spend a weekend in Tokyo really we just wanted to get here and get some rest.

You cannot enter the US then fly to Mexico. When an international flight arrives to the US all passengers must pass through CBP. At that point you would use your single entry for the K1. Now it might be an option to fly first to Mexico and then to the US afterwards. You'd both have to make sure you had all your documents required to enter Mexico as visitors and then make sure you also divulge that information on your papers when you enter the US.

Once she enters on the K-1 visa, she will have no valid way to reenter the U.S. until she either has AP or a GC. An unsurrendered I-94 does not permit you reentry to the U.S.

You stand a very real chance that she will be stuck in Mexico with no way to reenter the U.S.

Delay you excursion into Mexico until after she has AP or permanent residence.

Does she even have a visa for Mexico? Mexico requires a visa for citizens of Peru.

Timeline

While entering the country on K-1, my fiancee(now wife) was told not to leave the country till she got her AP or GC.

If I were you, I would make the trip either before your fiancee enters the US or after she gets her AP/GC.

We have made a few trips on AP but the time at the POE takes longer (something to keep in mind incase you have a connecting flight soon after landing at the POE).

K-1 Timeline:

Oct 06, 2008 - I-129F sent to USCIS

Jul 08, 2009 - Interview at Montreal Consulate

Jul 10, 2009 - US Entry. POE: Buffalo, NY

Jul 15, 2009 - Marriage

AOS Timeline:

July 29, 2009 - AOS, AP, and EAD sent to USCIS

July 30, 2009 - USCIS receives Documents.

Aug 05, 2009 - Received NOA Dated July 31.

Aug 10, 2009 - Biometrics letter. Appointment date: Sep 2nd.

Aug 13, 2009 - AOS transferred to CSC.

Sep 02, 2009 - Biometrics done at Elizabeth, NJ location.

Sep 16, 2009 - Received emails of EAD(Card production Ordered) and AP(Approval notice sent).

Sep 21, 2009 - Received 2nd email of EAD(Card production Ordered)

Sep 22, 2009 - Received AP.

Sep 26, 2009 - Received EAD Card

Oct 19, 2009 - AOS transferred back to NJ.

Nov 05, 2009 - RFE for I-693

Dec 02, 2009 - USCIS receives I-693 vaccination supplement.

Jan 06, 2010 - RFE for Entire I-693 needed since CBP/USCIS loses our documents.

Feb 04, 2010 - I-693 received by USCIS.

Feb 17, 2010 - Green Card in mail!!!

Conditions Timeline:

Nov 17, 2011 - Sent I-751 application to Vermont office.

Nov 22, 2011 - I-751 Receipt Notice/Extension letter sent by USCIS.

Jan 04, 2012 - Biometrics done at Elizabeth, NJ location.

Aug 31, 2012 - GC approved.

Sep 11, 2012 - GC mailed. USCIS says we should receive within 7 days

Yes you can do that but..........

The K-1 will allow her to get into the US. It will be canceled and replaced with a I-94.

She needs nothing to LEAVE the US.....however, she will need an AP or a GC to be able to Re-ENTER the US. A I-94 wiil not allow a re-entry; it only allows you to be inside the US.

Bottom line, get married in the US and then AOS and then go to Mexico.
