Hi all,

I have a few questions regarding my application for green card for my family. I am a US citizen by birth, the only one in my family who was born here. My mother, my father, and my youngest brother (age 18) live in Indonesia. My other brother(age 22) is attending college in the US with me with F-1/student visa.

I filed petitions for my mother and my 2 brothers separately last year. I understand that it will take many years before my brothers will be granted green cards, but my mother's petition has been transferred to the NVC for further processing and I am now in the last step before interview (filling out DS-230 form). In the form, it asks who would be accompanying my mother to the US and I want to fill out my father and my 2 brothers, so they can also come here as immigrants.

My aunt went through the same process, she applied for a green card 9 years ago and the petition just got approved and in the step after paying $70 fee to the NVC, she sent a letter to the NVC saying that her whole family (husband and 3 children) would want to come to the US with her too. After that, she receives 5 application document processing fees for the whole family (she paid $400 x 5 = 2000 dollars for the 5 people). What does this mean?

I did not send a letter like that to the NVC since I thought I can only apply for 1 person and I only included my mother solely and paid the $400 fee only for her. My Affidavit of Support also only include her. Now the DS-230 form came and it asks the question of who would my mother want to bring with her to the US. Can I add my father and my 2 brothers? I really want to get them all a green card. What should my course of action be? Should I just filed the DS-230 form and give them all the document requirements for my father and 2 brothers? I have been trying to call the NVC everyday and sending them emails but so far I have not received any reply and the phone always has a busy tone. Please help me, I feel like I have done something incorrectly and might cost my father and brothers their green cards.

You can only file DS230 for the person whose application has been approved and forwarded to NVC - so only your mother gets to come. Brothers will have to wait - average time is 10 years but for some countries it is even longer.

If you want to bring your father as well file another I-130.

I don't know the circumstances of your aunt's case -what visa/process did she go through? DV Lottery?

Since your brothers do not qualify as beneficiaries under your mother's petition since they are your siblings. If you had filed for your brother years ago and it was now being approved then his family such as wife and children would have benefited from your petition since they do no qualify for you to file for them. Does that make sense?

So you will have to let the I-130 petitions you filed for them take their own course and wait for them to be approved on their own. As for your father, you will also have to file a petition for him since you are his daughter and can file for him.
