AOS before or after I-94 expires

K-1 is a non-immigrant visa. I don't agree that you are "all set" to remain in the US after fulfilling the requirements of the K-1 visa. The 129-F says that you "should file adjustment of status paperwork as soon as possible.."

Let's hear from someone who's come into the US on a K-1 and decided not to file AOS indefinitely. I want to hear their story about how the US recognizes they are allowed to remain.

Think we'll be hard pushed to find that someone, since you'd have to be mad to draw attention to the fact that you have past your 90 days and haven't filed AOS. Again, the best qualified respondents would be either those with personal, anecdotal experience (which we do have and have alluded to in this thread already) and lawyers with case experience.

I think the more important question is "what happens to a K-1 who doesn't file AOS and if discovered/ detained, doesn't immediately file their AOS?"

Timeline Summary:

K-1/K-2 NOA1 - POE: 9 February - 9 July 2010

Married: 17 July 2010

AOS mailed - Interview : 22 November 2010 - 10 March 2011

ROC mailed - approved: 14 February - 18 June 2013

Citizenship mailed - ceremony: 9 February - 7 June 2017
