Hi to all vj family, I have a question about my son. By the way I arrived here in US on March 5 2009 and I'm already a greencard holder and now it's time for my son to follow me here. He is 11 years old and I want to know if he still eligible for the K2 visa and how and where to apply and what are the documents to prepare. And also what are the things to prepare for the escort since his still minor and cant travel all alone. Please I need your advise and thanks in advance.

AOS TIMELINE:

08/10/09 ------- Sent docs for I-693 to Dr. Arnold

08/17/09 ------- Got the sealed envelope from Dr. Arnold

08/21/09 ------- Mailed the AOS docs in USCIS (Chicago lockbox)

08/23/09 ------- AOS docs arrived @ USCIS signed by R. Mercedo.

08/27/09 ------- NOA for AOS,EAD & AP

08/28/09 ------- USCIS cashed check for $1,010

09/23/09 ------- Case transferred to CSC

09/26/09 ------- Biometric appointment. Thanks be to GOD

09/27/09 ------- EAD card production ordered

09/28/09 ------- EAD touched

09/30/09 ------- AOS touched

09/30/09 ------- USCIS mailed my notice of approval of AP

10/01/09 ------- AOS touched, initial review. EAD still on card production ordered

10/02/09 ------- EAD touched. Submitted form AR-11 for AOS thru online.

10/19/09 ------- AOS touched & received email from USCIS "card production ordered".

10/23/09 ------- GREENCARD RECEIVED WITHOUT INTERVIEW IN JUST 2 MONTHS.

10/24/09 ------- Welcome to the USA letter received

10/2011 -------- REMOVE CONDITON

REMOVAL OF CONDITION:

09/19/11 -------- Sent the I-751 in Vermont office

09/21/11 -------- Vermont office received my papers.

09/29/11 -------- Got the NOA1 dated 09/22/11

10/28/11 -------- Biometrics done

06/29/12 -------- Approved

07/05/12 -------- Received the 10 years Green Card.

Your son would need to have had his visa issued within a year of the date yours was issued. I take it that year has already passed. Your husband would now file an I-130 petition for his stepson in order to eventually obtain a CR2 visa.

Follow to join is available for up to one year from the date your K-1 was issued and the K-2 must be issued before that date.... based on your timeline that is 4 days from now... I would say an impossibility to get it done in 4 days but the process starts at the USEM with the DS-156, et al...

Suggest you stay up late tonight - call the USEM in Manilla, get a HUMAN, and tell them you are starting the K-2 FTJ case.

IF they allow you to start this - then you'll need to go fast with all of the documents (Fast - 24 hours from the timestamp on this post).

If the USEM will accept faxed documents from you, you might 'gain some speed'

Suggest you prep your documents this evening, dust off the fax machine as well.

There's a snowball's chance that she can do it - but I still say try to get the foot in the door, until USEM says 'NO!!!'

IMO, shouldn't waste more than 4 days of rushing around, getting things done, if she starts NOW.

Actually, I thought all was tied to the Interview Date - which was the 13th o February, 2009.

Isn't the 'date' tied to 'interview date' ? Or was it something else?

Yes, I see by the timeline that the visa was received February 27 and the interview was the 13th. I expect the visa issue date is the the 14th or 15th, more than a year ago. The OP can simply check the visa issue date on the visa itself to know for certain.

Hi Darnell, we did'nt make so we'll take the advice of pushbrk to file I-130 for CR-2 visa. I'ts hard coz I really miss my son so badly, but that's all we can do now. Thanks and God bless.

8 years? Where did you hear this? For a child of a USC it is probably 6-8 mos.

NO. If you (an LPR) file the petition for your son, it might take years. Have your husband (A US Citizen) file a petition for your his stepson like I said and it should take 6 to 8 months.
