I am a US citizen and I met my Indian fiancee through a matrimonial website called Jeevansathi.com. This is where we got in touch and since then we have emailed, phoned, and met each other. So I want to get a K1 visa for her. I'm filling out the I-129 form and I have to declare how we met and if we met through an International Marriage Broker. So is this site jeevansathi.com an International Marriage Broker??? Will saying that we met through this site cause any problems? Basically what I am saying is that I don't want to say that I met her through Jeevansathi.com and then have USCIS say that oh sorry this site is not compliant with the International Marriage Broker Regulation Act. Or, I don't want to have to go through a lengthy criminal record check. I don't have a criminal record, but I don't want to lose time on them checking. I just became a US citizen a year ago.

Here is some more info. On the instructions of the I-129 form, it says that the following is NOT considered an International Marriage Broker:

"Entities that provide dating services if their principal business is not to provide international dating services between United States citizens or United States residents and foreign nationals and charge comparable rates and offers comparable services to all individuals it serves regardless of the individual's gender or country of citizenship."

Jeevansathi.com is open to all countries, and is not designed specifically find partners for Americans. But the problem with this is that Jeevansathi.com does charge a little more for people living in the US than people living in India. For example, for the most basic membership of 2 months, if you live in India you pay $31 while if you live in US, you pay $43.

From what you posted about the site it does not fit the parameters of an international marriage agency.

However - just so that you know... I-129F processing always includes background checks, including NCIC and FBI name checks. Whether you met your fiancee through an agency or not you'll undergo a criminal background check at the USCIS and the NVC level. This is a part of the process and there's no way to circumvent them.

Thanks guys for your replies. That was reassuring. I was just confused because jeevansathi DOES charge more for its American customers and less for its Indian customers. This brings it closer to an IMB site. They shouldn't do that.

It could be an IMB, since they charge more for American customers - that is worrisome, however, I don't think it's principal business is to match make between USC/FN's.

(Plus the difference could be because of currency rates)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
