k3 or cr1 thats crazy

now i think they process my i-130 and cancel my k3 cuz they sent me online aos any way i need help from any one have the same visa cr1 cuz i really was profisional with k3 alot of time searching now they change every thing so what i can do in this step and dont tell look at the guide i didnt understand lol pleas need some help thank u mena

Well the CR-1/IR-1 is a much better visa than the K-3, so this is good news for you.

With the K-3, you don't get a green card as soon as you arrive in the U.S. You have to "adjust status" (pay more fees, wait through more processing.) You don't have the right to work until you finish adjustment of status and get the green card - this can take months to even a year or more. (There is a temporary 3-month work permit that is available, but that's another story and it's not really very helpful.) If you need to travel in and out of the U.S. before you get your green card, you will have to file for another paper called "Advanced Parole" which means another fee and more waiting.

But with the CR-1 (if you are married less than 2 years) or the IR-1 (if you are married more than 2 years) you don't have to adjust status - you are eligible for the green card right away. And you have the right to work immediately, and travel in and out of the U.S. without the advanced parole.

So congratulations if they are processing you for CR-1/IR-1 - be very happy for it. :dance:

No worries - after much painful waiting, I wish we would have just gone CR-1 - it's a bit of a relief to know that NVC made that choice for us!

In our case we would have had to cancel and start over ! K3 has 2 years to enter and CR1 only 6 months. My husband could not leave that soon as will be the case with those that have to finish out military obligations.

K3 was a PERFECT visa for us. And not everyone wants to or needs to work in the first month here.

The K3 was designed to reunite families quicker because NVC was backed up and behind OVER A YEAR in getting out visas. Losing the K3 option is not good news in my opinion. It wont be long til NVC is so behind they will have people screaming to bring back the K3. In 2002 before the K3, I knew 2 couples that seriously had a 2 year wait thru NVC. Thank God for K3! It gav families the CHOICE to wait out NVC or start their lives together.

egypt lover, the main difference is that the Affadavit of Support is approved at NVC level. A choice of agent form needs to be signed and there is alot of back and forth at this stage. After you enter on a CR1 you have to 'Lift Conditions' to get the 10 year card in 1 year 9 months.

Jackie - I'd have to say your case was a bit different than most folks doing the K-3. Most K-3ers chose it because it used to process faster than the CR-1/IR-1 (not because it had a longer window to travel.) And many have said afterwards that they wished they'd done the CR-1/IR-1 instead. I'm glad it was available for you, as it fit your needs.

Anyway, due to changes in the processing system, the K-3 is not reliably quicker any more... I guess that's why it's being phased out.

I'm just trying to tell egypt lover that the switch to a CR-1/IR-1 is nothing to worry about and it's actually a better visa (at least for most people, unless by some chance he needs to wait up to 2 years to travel to the U.S.)

egypt lover - the visa process is very complicated, and (as you can see from this thread) the answers to questions can sometimes be complicated as well !

But if you are able to travel to the U.S. within 6 months of getting your visa, and if you want the right to work as soon as you arrive in the U.S. -- then the CR-1/IR-1 is the best visa for you.
