ok i am tired of this waiting game . my i-130 has been pending for almost 18 months and nothing yet and i am planing to file lawsuit against uscis . every time i call or request an expedite i get the same answer (background checks) and wait 90 days . i need surgery's and i have lost my house and car and i have letters from doctors and evidence to support my claim . is it a good idea to file the lawsuit? and how long does it take to get an answer ?can someone give my tips about the process please? i it for sure thing ? thank you all

Filing a lawsuit against the US Government isn't going to speed things up. Contact your congress person and see if they can help.

several ppl here were successful with a writ of mandamus.

search here on 'mandamus' - you'll find a lot of detail.

also - look up 'gogo' prior posts - he's included a file attachment for a telephone book of 'ppl to call'

My I-130 took 14 months to be approved. Every time my senator/congressman tried contacting USCIS I would get the same answer. The case is with FBI and we should not inquire for another 90 or 180 days. So I guess your background check is taking longer. By the way in my case there were another person with same name last name and even birthday.

And as Darnell said search this forum. There was a user who successfully filed a lawsuit.

Good luck and try to stay positive. You might get an approval anytime even if they say to wait for another 90 days.

02/08/2008. I-130 delivered to Chicago Lockbox. Signed by V BUSTAMANTE

02/20/2008. I-130 NOA1 date. Vermont Service Center

08/26/2008. Touched. (I-130 transferred to California Service Center)

08/27/2008. Touched.

08/28/2008. Touched. (This case is now pending at the office to which it was transferred)

08/29/2008. Touched.

lookup 'gogo' prior posts - he's included a file attachment for a telephone book of 'ppl to call'

then run through this telephone book, calling everyone in the telephone book who's TITLE might deem worth a phone call.

it also would not hurt to send out emails and snail mail to anyone you can find an address for even if you think they can not do any good......sometimes it works

I was having issues with USCIS even looking at my case. It was returned after visa denied at the interview and after two years I was sick of it and consulted a lawyer and he mentioned the writ of mandamus lawsuit. The lawyer sent a letter to USCIS threatening the lawsuit and believe it or not, within 30 days there was action on my case after 2 yrs of just sitting there and after failed status request after another. So just do some research on the writ of mandamus and prepare a letter and send it to them and see what their reaction is, a nice professional letter showing that you know what you are talking about and that you know what your options are will show the USCIS that you are not playing games. And if that does not work, consult a lawyer and file the lawsuit. it basically forces the USCIS to act on your case on the belief that they are intentionally delaying your case for no just cause. sad_angel - a follow up.

I had made some time, this weekend, to read-up on gogo's plight.

some 'highlights' -

1. he filed a writ of mandamus lawsuit, and the casefile moved on to the next step.

2. lots of USCIS blunders after it started moving, resulting in a request, on interview day, for a 601 waiver to be filed (request from the Consulate, to him).

3. he used that telephone book to identify to some folk, in that list, just HOW there was a procedural error for US Federal Employees, and had the 601 waiver request sucessfully rescinded.

Good on gogo, but in the same breath, IMO, it's a solid example of 'what could go wrong, with these Federal Employees' and what to do, to overcome stupidity and procedural errors by these same Federal Employees.

Let me know if you are not able to read gogo's stuff here. I'll step you through 'how to find him, how to find his stuff here', if that is the case.

FWIW, in the end, gogo prevailed - his lass got the visa, she's in the USA with him.
