Timeline

I am refiling my I-129 F

Question 11 stats

"Have you ever filed for this or any other alien fiance or husband/wife before?"

"If 'yes' give name all of aliencs, place and date of filing A# and result."

I filed for the same person on 05/01/2008 in San Diego, CA

Do I need to provide more information or provide a copy of the first I-129 F

Without knowing what the outcome of your previous filing was (withdrawn, denied, etc) you could include some evidence to support it along with perhaps a brief explanation - since you'll be dealing with HSMC it might not be a bad idea to include something (although a copy of the previous I-129f isn't something I'd include though). All that is required though are the questions be answered on the form.

Add the A number and result as instructed. If A number is unknown, so state. This is really straight forward. I would also include a separate carefully written and well thought out letter of explanation.

The location should not be San Diego. It should be CSC for California Service Center. You do need to provide a brief statement (one sentence) of the outcome.

Technically, if you file before May 1, then it is inside the two year window and you need a waiver. If you file after May 1, then your second I-129F petition is outside the two year window and you do not require a waiver.

The waiver is not an official form or document to be submitted but might require a more extensive investigation. Thus you might need to document or explain in more detail than has been suggested so far. I am not sure what the actual difference would be.

we were denied, so i could include a copy of the letter i received from USCIS in the packet or i could type out a brief explanation and include it on my cover letter. Which would be better?

I would copy the letter from the consulate and blue slip with reasons for denial along with evidence to rebut the Consulate's findings for the denial. You will have to address the denial at some point.

Consulate Received : 2007-06-09

Interview Date : 2007-08-16 Case sent back to USCIS

Receive NOIR: 2009-05-04

Sent Rebuttal: 2009-05-19

NOA rebuttal entered: 2009-06-05

Case sent back to NVC for processing: 2009-08-27

Consulate sends DS-230: 2009-11-23

Interview: 2010-02-05 result Green sheet for updated I864 and photos submit 2010-03-05

APPROVED visa pick up 2010-03-12

POE: 2010-04-20 =)

GC received: 2010-05-05

Processing

Estimates/Stats : Your I-130 was approved in 140 days.
