im pilipina just arrive 2008 in u.s and green card holder ...im married for the 2nd time in philippines with u.s citizen since 2005.and i have 10 year old son left in the phippines,im previously married to his dad last 2000 but after 1 year we got separate and now he has own family with 2 kids.my question is how can i bring my son in u.s if his birtcertificate saying im married to his dad..is my u.s citizen husband can petition my son as his step son??i am very confused please helppp me..thank you.

Hi Pamela.

You should file the petition for your son using I-130. Although you might want to consult an immigration lawyer because there are several factors I am not sure of.

For example, it is possible that it would be better (faster) for you to wait till you become a US citizen before applying for your son.

Also, Im pretty sure that your son's birth certificate saying that you used to be married to his dad wont be a problem. But you might need your ex husband's blessing or something.

In a nutshell, yes you can petition your son but like I said earlier, the safest route is to consult a lawyer.

Yes your husband can petition him as his step son. I think that would be the shortest time to get him his visa. good luck
