John, I am sorry, but how do you know this? Do you experiences with lawyers to prove this?

I have first hand experience using a lawyer with a very similar case as Scott's. Without using the lawyer I probably would have waited much longer for my wife to get her visa, and who knows, maybe denial. My wife was given a blue slip first interview. She came back and submitted what was asked and was given a green slip. At that point I hired a lawyer. Thankfully I did, because they had our case mixed up. He was able to help get the facts straight and provide the consulate with the needed paper work and VISA was approved!!!!!

He can sit there and wait and wait or hire someone that can keep things moving. That is just my opinion.

Whatever you choose Scott, I wish you the best of luck.

Scott, remember to write a coverletter/brief and attach to your evidence. In that brief you should state all your point of contentions on how the CO handled the inteview. If anything it will be in writting and not hear say, also get it notirized when you are there. If possible try to get a supervisor signature on there as well, just to let the CO know that you have got management involed. I hope you read this b4 you go. Maybe what I am suggesting is arugmentative, but I feel that the position you been backed into. Good Luck today and Make it worth your wild.

Round 1 (K-1)

Mar-16-09: interview (blue slip)

Mar-25-09: returned with blue slip denied, (white slip)

Jun-04-09: nvc received returned petition

Jun-08-09: nvc forwards to uscis

Jun-19-09: noa3 uscis received ( pending under review)

Sep-17-09 : touched!!!

Sep-21-09: Notice of Decesion, Expired free to file again

Round 2 (K-1)

(1st denied case received & forward dates at NVC,and 2nd refiling & noa1 at uscis are identical ....how ironic)

I-129F sent: Jun 04-09

noa1 recvd: Jun 08-09

noa2: Sep-17-09 APPROVED

noa2 Hard Copy: Sep 21-09 called CSC said not approved still pending in system (#######!!!!)

noa3 recvd: Nov 25-09 USCIS is reopening case NOA2 was issued in error.(Government Motion to Reopen)

RFE ( NOID) recvd: Dec 18-09 ask to give rebuttal on consulate finding regarding 1st petition

RFE sent: Dec 20-09 rebuttal submitted plus able to front load additional proof.

noa4 recvd: Dec 28-09 APPROVED FINALLY

NVC recvd: Jan 04-10

NVC left: Jan 12-10

Consulate Recvd: Feb 05-10

Packet 3 submitted: Feb 09-10

Packet 4 Recvd: April 16-10

Interview : May 12-10...PINK SLIP already on the table (2years 1week later)

Visa Pickup: May 28-10 In Hand!!

I agree with you, hopefully Scott will read before he goes there. It something like this is notorized and with the questions asked and the frankness of those questions, it might help. Good luck

Dont worry John, some people feel that what worked for them is the only thing that will work for others. You did good with your visa, and have helped others out. Dont let people bother you. We know that everyone has an opnion, just try not to let someones opnion bother you that much. What is the thing your wife loved most about america?? Was it the stores? What one? Already been and gone. Same girl from yesterday and she was really nice today. I'm all set with the evidence. Took a while to get it all through the slot. Flying back tonight. Meeting congressman on Friday. Will be calling DOS daily and congressman can inquire as often as I like. So many people in same boat with no idea what to expect so I was recruiting today for VJ.

Great, sounds like the visit today went really well, no secruity issues I assume. Have a safe flight home, God Speed

no problems with security.. they had mr cool walking a beat farther down the street that day... and he was back with the hat and shades again... I was early and the guy at the gate said I could hang out there and wait no problem... I was first in and first out... there were a great many people already inside for interviews... The CO that I talked to obvously does not work immigrant visas much as she was unaware of some of the policies and had to ask someone else to get an answer.. example: I mentioned that Thuy lived so far north and that it gets expensive back and forth so much... and that when they issue the visa if she could come down with the passport and then have the visa courriered to her... like other consulates do... she said sure no problem... not true... it is done on the non IV side but not yet on the IV side... but is in the works to be done on both sides...

Wow that flight sucked...

So what is the deal? It sounds like you are in AP as they have not made a decision? Did they give you the canned response that they were working on your case, or did they give you a supossed timeframe for you to work with? You are talking about picking up a visa again before you are approved, so were you approved or are you just thinking you will be approved? Hope is great, but remember expect the worst and hope for the best, so that if it does not work out like you wanted you are not so bummed out. Good luck, sounds like you might be needing it. Jerome

Last month Thuy went to a fortune teller.. I guess it is more common that I had previously thought... I knew they sought the advice of a fortune teller in VN on many things, but I had never been in the loop until now. They did ask about her and I before we were engaged and got the thumbs up.... last month the fortune teller told her we should be out of AP and together by the end of April or May... she went to talk to a different fortune teller today and this one said that she would get news from me after 10 days and that soon after that she would be traveling a long distance.. I didnt want to be the bad guy when she told me this so I only responded that I hope they are right and we will see...

If they are in fact correct, this would bring a new perspective to the whole thing on my part..

I have never heard of the fortune teller thing here in Vietnam, I will have to look into it, sounds fun to me. I am like you and do not have much faith in it. Dont worry Scott, you should hear something by the end of this month. I know AP is hard on people, just keep trying to keep Thuy and yourself calm, it will all work out in the end one way or another. Staying focused on working on my car is really helping both of us... I do the work and then we talk about it each day... alot of progress in the past week... so alot to talk about and productivity is a plus...
