OMG, you was in same boat as my SCOTT.

I wish everybody get denial like me.

CR1 timeline:

11/2008: submit I130

11/15/2008: case sent to CSC

06/02/2009: uscis approval

08/05/2009: interview-get blue slip request timeline

08/25/2009: submit timeline - get denial blue slip

All I have to say is this is HCMC expect the worst and hope for the best. Going in there pissed off might have worked for Fred, but I am sure that it will usually not work. Also the comment was made that if they deny you can do something about it. That is 100% wrong, I had my senator working on my visa back here and got in touch with one of the head people of USCIS stateside, and it WAS PROVEN that the Co in HCMC did wrong, and made FALSE statements, this means proof not just me saying he lied. We had the CO's notes that were forwarded to USCIS stateside per my senators request as well as the person at USCIS where the Co's own notes PROVED that he lied in reasons for the denial, and news flash NOTHING COULD BE DONE, only to refile or do a rebuttal IF they did not let the application expire. This entire process you have been looking for the next step Scott, I am not saying this is a bad thing, I am just telling you that for some reason they are messing with you as they did with Binh and me, does this mean you are going to get denied like we did??? I am not going to say yes to that. You did not get a denial, and tomorrow no matter how hard you push they will more than likely tell you that they need time to process this information so you are like most of us, stuck in AP at HCMC. With the fact that the Co can openly lie on any reason for a denail with no repercussions then I would tell everyone not to go and make a scene since they can deny just out of spite. If you rock the boat to hard you might fall in. All I am saying is sit back and breathe, it is not over yet, if they deny you can refile or get married then try for a cr1, you can wait for a rebuttal, there are options, but if you go in there half cocked and piss people off the second go around will not be easier since they will remember you. This is the reason we decided that I would move to Vietnam after all, I raised all kinds of noise with my lawyers and senators help state side, I was even advised by the man from USCIS through my lawyer not to file right away since they would remember my petition and be looking for it. It is pretty sad when they know the system is corrupt and they will not do anything about it, but that is life. Just calm down, accept the fact you are in AP and see this as a good sign, not a bad one. Jerome

Thanks Dan, the conference call with everyone really helped. She feels much more comfotrtable now. The folks wishing the worst for us don't mean a thing. I know I will be able to talk to the CO and make progress. The last I talked to the congressional liason he said let him know if there are any problems so he may get the call tonight v

Think what you want, do what you want. I do not wish the worst for anyone. Point is that what happens happens, if you go in there pissed off and make them mad, you will be the one that has to always wonder if you were the reason, and then the same goes if you dont go in there and make a scene, you will always wonder if that would have helped. You have preached to many people in the past to not get ahead of themselves, and you have always preached in the past how bad it was in HCMC, then you do the exact oppisite, you are already planning your trip home together. I am not trying to stomp on your dreams, I am simply stating what you dont want to hear, but not so that you worry, just so that you slow down and relax. Until you get a denial it is not over. I spent $3000 for a lawyer to find out what they did, he actually got through to USCIS both in HCMC and stateside, he was able to get all the CO's notes on our entire case, that is how it was proven he was lied about our case. I am not making this up. USCIS said there was NOTHING they could do, and my lawyer agreed. My state Senator got this same information, and he also said there was nothing he could do. Maybe you typing that you are going to do this or do that makes you feel better, but fact is the CO'c look at these forums, our CO had notes about the things I wrote, he actually had print outs of some of my topics. These things you can think are lies or not, but seriously Scott you need to just calm down dont waste the money I did for no results. If you think I am not telling the truth pm me and i will give you my lawyers number, and i can email you the documents he gave me, and even the USCIS guys letters. You just really need to calm down as of right now to me it looks like you are only in AP, and you still might get the visa, and there is one loop hole that I see you have not even thought of. You turned in the evidence they did not give you another blue slip, this is a no no, once you did not turn in the requested evidence another blue slip should have been issued and it wasnt or if it was you did not post that. So now that you gave more information they need to note this in their file, if they do deny you then they did not follow proper protocol, but in my case they didnt do that either. This is the only thing that you can get done. The only recourse I have is to actually file a complaint in our case that my rights as a United States Citizen were trampled on and I was not given the due process that I deserve, with his notes it is a slam dunk. But this is also why I am moving there because with this case going on, there is no way I can file for another visa. After I win, then maybe something will actually be done, but until then there is truly nothing that can be done. All i am saying is do what you can live with, but dont give them a reason for a denial. Jerome

Sorry to hear your troubles Scott, I was in the same boat that you are in right now but I was one of the ones that went away and did as I was told. Ultimately the denial sticked and I can reapply at any time. I have wondered whether or not if I had taken a different approach whether or not something could have been done and to be honest I think that even if I did go all up in arms I'm not sure it would have done any good. Stay strong as Jerome has listed you do have options, yes those options will cost you more time apart from one another but you still have options to get her over to be with you.

Scott, how are you doing, I hope your feeling better right now. I heard and saw what happened today at the consulate. I was the one who asked you if you wanted some water. Like I said eariler dont expect miracle to happen. After a couple visits and listening to the CO overhere I come to the conculsion that they are merely CSO (custumers service officers). They cant do much and sometimes insenstive at times. Case in point, today a lady was asking how long will her AR take to the same CO you spoke to. She immediatly went into her DOS, BS, speach. But after the girl showed her another pieace of paper with an appointment date, she started to change her tone instantly. They make up stuff as they go along just to statify the USC. Things could have been handled diffently, but right now you have no choice but to let things run its course. Good Luck

I appreciated it... It just got to be too much and I about passed out.. I'd swear she was reading a script... I was really amazed at how she dealt with the whole evidence deal... They glanced at it at the interview and then gave it all back to Thuy and the lady asked me if I wanted to submit any thing I could... I said it had already been submitted and returned to us... she didnt have the file, could not say what was in it or not and could only say that we had provided what was requested... while I was getting it all back together she asked another guy to come to the computer screen and was pointing at me and then they both went over some stuff on the screen together and then only him... he walked away and came back to the screen a few times.. And then she went on to the remaining few cases.. after everyone left she asked me back to the window... asked how was I feeling and said the nurse had left already and that I was on my own... gave me a few minutes and said I had to leave and could come back tomorrow... will be back tomorrow to load up every piece of paper that they did not accept at the interview... heading back to US tomorrow night...

I know its just a matter of time before she is here... its a legit relationship and we have not done anything wrong... I have many more resources available here than Jerome knows about so when I get back I can start making those calls...

did you see the guy with the cowboy boots? wow.. that was some sh!t he is going through... just got off the phone with the congressional liason that dealt with my AP last year and he will address it for me...

It is no secret that they go through these discussions from time to time... both days I was there the guy I got into it with had those dark shades and a hat on... today no hat and the dark shades were gone after my cool hand luke comment...

It sounds like Scott got put into AP. That sucks, but it is much better than any denial, so hopefully when they get their heads out of their butts they will give him the visa that they both deserve to have. My personal belief is Ap is cruel and unusual punishment, i would prefer to either get a denial or approval, when you are in AP you only get canned responses and there is nothing that can really be done. The one good note is that I think there are more instant denials than denials resulting from the AP process. SO they might not be sure but more often than not they do pass those in AP. That was one of the steps I insisted you should have done eariler in your interview post, At that time you were only concentrating on the requested docs. I hope you can now see what i was thinking, I was trying to let you play the game 2 moves ahead. Tommorow use the faint tatic again it was very dramatic, I also saw a little panic in the CO as well as myself. Insist to speak to supervisor in your matter I have seen it do before if you push hard. Also, dont sit overthere where you where earlier, sit close to the windows, so you can learn their tatics. Good Luck

It was real when I was at the window. I could have used that water but didn't want anyone to have to deal with what I was going through. Thought I was going out a couple of times and when I was sitting there the reality of how this was physically taking a toll had sunk in. Didn't have much to eat today and was way overdressed for a room with only fans. It was like talking to NVC when I was in AP again. A scripted limited response and not easy to get a supervisor. When I asked to speak to one is when she said we are done for the day.

I am really sorry to hear the news. This is the time when you need to be most focused and level headed. Going to the consulate and making a scene is the absolute wrong decision. Of course things don't always go the way we think or wish, but we can't lose are calm and focus. Don't give them any more reasons to deny you the visa.

It is time that you make a call to the lawyer I mentioned to you. He will get to the bottom of all of it and make sure everything is understood and what is needed.

John, I am sorry, but how do you know this? Do you experiences with lawyers to prove this?

I have first hand experience using a lawyer with a very similar case as Scott's. Without using the lawyer I probably would have waited much longer for my wife to get her visa, and who knows, maybe denial. My wife was given a blue slip first interview. She came back and submitted what was asked and was given a green slip. At that point I hired a lawyer. Thankfully I did, because they had our case mixed up. He was able to help get the facts straight and provide the consulate with the needed paper work and VISA was approved!!!!!

He can sit there and wait and wait or hire someone that can keep things moving. That is just my opinion.

Whatever you choose Scott, I wish you the best of luck.
